PAGE 1 OF 4 nOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC iJiiCROFIL\1m RESOLUTION NO. 92-144 A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF LOT 7, BLOCK E, GOLDEN SAGE RANCHOS UNIT 68, SECTION 27, TOWNSHIP 22 NORTH RANGE 19 WEST, FROM: A- R/2A (AGRICULTURAL RESIDENTIAL/~O ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to determine whether approval should be granted to Frank Bartha of Hemet, California, for a zone change from existing A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone to A-R/IA (Agricultural Residential/One Acre Minimum Lot Size) zone, located on Elgin Road, 1,700 feet south of Chinle Drive in the Golden Valley area, and WHEREAS, Section 27 is approximately two and one-quarter (2.25) miles north of Highway 68 and approximately nine (9) miles west of the Highway 68 and 93 junction. The subject property is accessed from Highway 68 via Estrella Road north approximately two and three-quarters (2.75) miles to Todilto Drive, thence west approximately one-half (.5) mile to Elgin Road, thence north approximately 330 feet to the southeast corner of the subject property, and t' . . Page 2 WHEREAS, review of the floodplain map #040058-2150B indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land. There are approximately three existing homes on this block. The applicant desires to split this 2+ acre parcel into two 1+ acre parcels, and WHEREAS, the Planning Commission previously recommended denial of this action and the Board of Supervisors sent this request back to the Commission for further consideration, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The two parcels be zoned A-R/1A Residential/One Acre Minimum Lot Size). (Agricultural- 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a m~n~mum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. Both parcels shall meet or exceed one (1) acre exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage and the FEMA flood zones. . . PAGE 3 OF 4 BK 2046 PG 813 (FEEt92-24094) Resolution No. 92-144 Page 3 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. That appropriate zoning, building and environmental permits be obtained. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being June 3, 1992, as per ARS 11-829E. 10. If these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Final Plat and Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions on prints. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 19, 1992, and posted April 17, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Zoning Regulation through the J (' r-J , , , , 'l>..;.;) . .
