The Resolution 92-143, (at fee No. 92- 24093 Book 2046 pages 808, 809, 810 was therefore erroneous and therefore as Clerk of the Board of Supervisors, request that this affidavit of erroneous recording be duly recorded this 4th day of June, 1992. PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 92-143 A RESOLUTION AMENDING THE MORAVE COUNTY SUBDIVISION REGULATION BY SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY PLAN OF MOUNTAINSIDE RANCH, TRACT 4106, W~ SECTION 6, TOWNSHIP 18 NORTH, RANGE 21 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to determine whether approval should be granted to Gary Morgan, Vice-President of Homes by Dave Brown, Tempe, Arizona, for an extension of time for the approved preliminary plan of Mountainside Ranch, Tract 4138, W~ Section 6, Township 18 North, Range 21 West, located in the South Mohave Valley area, and WHEREAS, the owner/developer of this tract is Homes by Dave Brown, Tempe, Arizona. The engineer responsible for the preparation of the drainage report and design of this subdivision is William Miller of Holland West, Inc., Englewood, Colorado, and WHEREAS, this proposed subdivision consists of 206 acres with 1004 units and commercial development. The project was originally approved for four (4) phases. This project is located on the northeast corner of Boundary Cone Road and Bison Road. Parcel C which is located on the south side of Boundary Cone Road is proposed for multifamily and commercial, and r 1 l . -j _J .~ .. .~ -- PAGE 2 OF 3 BK 2046 PG 809 (FEE~92-24093) Page 2 Resolution No. 92-143 WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of Supervisors on May 7, 1990, via BOS Resolution No. 90-113. A preliminary plan approval has a limit of two (2) years from the date of conditional BOS approval before it expires. The Mohave County Subdivision Regulations allow for an extension of time in increments of one (1) year. This is the first request for an extension of time, and WHEREAS, a final plat of Mountainside Ranch Tract No. 4106-A was conditionally approved by the Board of Supervisors on September 17, 1990 and recorded December 18, 1990. A final plat of Mountainside Ranch Tract No. 4106-B was conditionally approved by the Board of Supervisors on December 17, 1990 and has not been recorded yet. A final plat of Mountainside Ranch Tract No. 4106-C was conditionally approved by the Board of Supervisors on December 17, 1990 and has not been recorded yet. A final plat of Mountainside Ranch Tract No. 4106-D is now being processed, and WHEREAS, the Planning Staff received an updated preliminary phasing plan on February 6, 1992. This plan has seven ( 7 ) phases, contains discrepancies and omissions, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992, the Commission recommended conditional APPROVAL of the requested extension of ; j ~ 'j ; , , , ~ j ,I i ~ ,; 1 i .j i .j . ,r\ -. in.. , " " o Resolution No. ':r2-143 Page 3 time with the applicant understanding and accepting the following condi tions : PAGE 3 OF 3 ilK 2046 PG 810 (FEE~2-24093) 1. In the letter dated February 13, 1992, Mr. Gary Morgan, Vice President of Homes by Dave Brown, requests an extension of time for the conditionally approved preliminary plan. The reason given for the extension request was a slow down in the real estate sales market. 2. An updated preliminary phasing plan should be submitted for file purposes which includes an update of the land use summary documentation and ,the Tract number. 3. All items addressed on Public Works comment letter dated' March 6, 1992, including the submittal of a revised drainage report shall be addressed. 4. This extension of time will, extend the conditional approval for the preliminary plan Tract 4106 as approved by BOS Resolution 90-113 until May 7, 1993. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave county, Arizona, on April 19, 1992, and in the Mohave Valley Daily News, and posted April 17, 1992 as required by Arizona l;l.evised and the Mohave Statutes, County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that ,the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Subdivision Regulation by the gJ;"anting of this extension of time for the preliminary plan, Tract by the Mohave County Planning and herein.
