PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He 4 RESOLUTION NO. 92-142 A RESOLUTION AMENDING THE MOHAVE COUNTY SUBDIVISION REGULATIONS BY SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR A MEDIAN ENTRANCE INTO RANCHO PALO VERDE, TRACT 4138, DESCRIBED AS THE NE~ NE~ SECTION 1, TOWNSHIP 17 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to determine the approval of the Petition of Exception for a median entrance into Rancho Palo Verde, Tract 4138, lying within the NE~ NE~ Section 1, Township 79 North, Range 22 West, located in the South Mohave Valley area, and WHEREAS, the owner/developer of this project is Doug Maxwell, Maxis Incorporated of Scottsdale, Arizona. The engineer of record is Michael Mayer, P.E., of Standage and Truitt Engineering, Ltd., in Mesa, Arizona, and WHEREAS, the preliminary subdivision plan depicts forty plus (40.16) acres divided into one hundred sixty eight (168) lots having a minimum lot size of 6,000 square feet and maximum lot size of 15,000 square feet for an overall density of 4.2 lots per acre, and '- .. . . PAGE 2 OF 3 BK 2046 PG 806 (FEE~92-24092) Page 2 Resolution No. 92-142 WHEREAS, access to the development is provided by Laguna Road on the North, which is an improved county road leading to State Highway 95, approximately one and three-quarters (1.75) miles to the west. Vanderslice Drive, an unimproved, maintained county road to the east, also provides access and which leads to State Highway 95 approximately one and three-quarters (1.75) miles to the south. Water will be provided by Lagoon Estates Water Company, with Fort Mojave Tribal Utilities serving the sewage disposal system. Solid waste disposal will be provided by private hauler. The project will be served by Mohave Valley Fire District, and WHEREAS, Anderson-Nelson, Inc. has submitted the Final Plat and Improvement Plans for Rancho Palo Verde to the Planning and Zoning Conunission for approval which includes a certain deficiency not previously requested under Board of Supervisors Resolution 91-195. The request is to allow a median entrance road as shown on Detail "A" & "B" page 1 of the paving improvement plans, and WHEREAS, this petition is submitted as a request that the Planning and Zoning Conunission reconunend to the Board of' Supervisors the granting of an exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: ,- . . PAGE 3 OF 3 BK 2046 PG 807 (FEE~92-24092) The granting of this petition will not be detrimental to public welfare or injurious to other adjacent properties because the request is for a median entrance road that will serve only this subdivision. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because the Master Plan does not address subdivision entrance roads sections. 3. The special circumstances or conditions affecting said property as follows: A. The entrance road serves no residential lots. B. Ironwood Way and Palo Verde Way are only 120 feet in length. C. The landscaped median entrance road will add to the attractiveness of the subdivision. D. The pavement width on either side of the median is 22 feet, face of curb to face of curb. This meets the County collector road section design. WHEREAS, the Commission, at their meeting on Wednesday, April 8, 1992 recommended APPROVAL of this Petition of Exception based on the aforementioned justifications. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Subdivision Regulation by .the granting of this petition of exception as recommended by the Planning Commission and outlined herein.
