PAGE 1 OF ~ MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne /1 c,1" RESOLUTION NO. 92-141 A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A PUBI.IC UTILITY FACILITY, BEING AN ELECTRICAL DISTRIBUTION SUBSTATION, IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE, IN A PORTION OF SECTION 13, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held May 4, 1992 a public hearing was conducted to determine whether approval should be granted to Mohave Electric Cooperative of Bullhead City, Arizona, for a zoning Use Permit (ZUP) for the establishment of a public utility facility, being an electrical distribution substation, in an A-R (Agricultural Residential) zone, located in a portion of Section 13, Township 19 North, Range 22 West, in the South Mohave Valley area, and WHEREAS, Section 13 is located just south of Bullhead City~s southernmost border and one (1) mile east of highway 95. The section is bounded by Mountain View Road, Camp Mohave Road, Vanderslice Road and Sterling road extension. The subject property is accessed from Highway 95 via Camp Mohave Road east one (1) mile, thence north on Mountain View Road approximately one-half (.5) mile to the northeast corner of Jamie Road and Mountain View Road, and -~ ,I . Pl20F BK 2046 PG 4 802 (FEE~92-24091) Resolution No. 92-141 Page 2 WHEREAS, review of floodplain map #040058-24350 indicates this property to be clear of a designated floodplain. The site is currently vacant. The property is part of the proposed Sunset Ranchos, Tract 4046-C and is identified as Parcel I. Surrounding land uses consist of vacant land to the southwest and the proposed Overlook, Tract 4137 to the west. There are currently four (4) residences to the south in River View Ranches, Tract 4005-A, and WHEREAS, the applicant, Mohave Electric Cooperative, desires to establish an electrical distribution substation on this site. Proposed access appears to be on Jamie Road. There may be a problem with access until the subdivision is recorded or other provisions are made to access the site, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provlSlons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. . If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 8. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 9. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. PAGE ~ OF ~ BK 2046 PG 804 (FEE~92-24091) Resolution No. 92-141 Page 4 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 19, 1992, and in The Daily Spectrum and Desert Echo, and posted April 17, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Zoning Regulation by granting this Zoning Use Permit as recommended by the Mohave County Planning and zoning Commission, subject to the conditions outlined herein.
