AFFlDA VIT OF ERRONEOUS RECORDING
At the Board of Supervisors meeting held May 4, 1992, the Mohave County Board
of Supervisors CONTINUED INDEFINITELY the resolution requesting an extension of
time for a Zoning Use Permit establishing a mobile home as a sales office in an
A-R (Agricultural-Residential) zone, located in Mountainside Ranch, Tract 4106,
Section 6, Township 18 North, Range 21 West, located on the north side of
Boundary Cone Road 2+ miles east of Highway 95, located in the South Mohave
Valley area.
'The Resolution 92-140, (at fee No. 92-24090 Book 2046 pages 797, 798, 799, 800)
was therefore erroneous and therefore as Clerk of the Board of Supervisors, request
that this affidavit of erroneous recording be duly recorded this 4th day of June,
1992.

A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY
SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT
ESTABLISHING A MOBILE HOME AS A SALES OFFICE IN AN A-R
(AGRICULTURAL RESIDENTIAL) ZONE, IN MOUNTAINSIDE RANCH, TRACT
4106, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 4, 1992, a public hearing was
conducted to determine whether approval should be granted to Gary
Morgan, Vice President of Homes by Dave Brown, Tempe Arizona, for
an extension of time for a Zoning Use Permit establishing a
mobile home as a sales office in an A-R (Agricultural
Residential) zone, located in Mountainside Ranch, Tract 4106,
Section 6, Township 18 North, Range 21 West, on the north side of
Boundary Cone Road two plus (2+) miles east of Highway 95 in the
South Mohave Valley area, and
WHEREAS, the owner/developer of this tract is Homes by Dave
Brown, Tempe, Arizona.
The engineer responsible for the
preparation of the drainage report and design of this subdivision
is William Miller of Holland West, Inc., Englewood, Colorado, and
WHEREAS, this proposed subdivision consists of two hundred
six (206) acres with 1004 single family units and commercial

development. This project is located on the northeast corner of
Boundary Cone Road and Bison Road.
Parcel "C" which is located
on the south side of Boundary Cone Road is proposed for
Multifamily and Commercial, and
WHEREAS, the preliminary plan for this tract was approved by
the Mohave County Board of Supervisors on May 7, 1990, via BaS
Resolution No. 90-113.
A final plat of Mountainside Ranch Tract
No. 4106-A was conditionally approved by the Board of Supervisors
on September 17, 1990 and recorded December 18, 1990.
A final
plat of Mountainside Ranch Tract No. 4106-B was conditionally
approved by the Board of Supervisors on December 17, 1990 and has
not been recorded yet. A final plat of Mountainside Ranch Tract
No. 4106-C was conditionally approved by the Board of Supervisors
on December 17, 1990 and has not been recorded yet. A final plat
of Mountainside Ranch Tract No. 4106-0 is now being processed,
and
WHEREAS, the Planning Commission received a letter of
request for a time extension on the Zoning Use Permit (ZUP) as
conditionally approved by Board af Supervisors Resolution 90-357
allowing the establishment of a mobile home as a sales office in
an A-R (Agricultural Residential) zone.
This ZUP was approved
with a one (1) year approval and provisions for one (1) extension
of time for one (1)year, and

WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on April 8, 1992, the Commission
recommended conditional APPROVAL of the requested extension of
time with the applicant understanding and accepting the following
conditions:
1. In the letter dated February 13, 1992, Mr. Gary Morgan,
Vice President of Homes by Dave Brown, requests an
extension of time for the (expired) ZUP. The reason
given for the extension request was, "The real estate
sales market has slowed dramatically in Mohave Valley
during the past year and we need to remain in our
existing sales facility for a longer period of time
than originally anticipated."
2. The applicant shall provide for aggregate cover on the
entrance drive and parking area as originally required
and shown on the site plan.
3.
All requirements and conditions of BOS Resolution 90-
357 shall remain in effect.
4.

6. This extension of time will extend the conditional
approval for the ZUP approval until May 4, 1993.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on April 19, 1992, and in the Mohave
Valley Daily News, and posted April 17, 1992 as required by
Arizona

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, May 4, 1992 approved this
Amendment to the Mohave County Zoning Regulation by granting this
extension of time for a conditional Zoning Use Permit as
recommended by the Mohave County Planning and Zoning Commission
and outlined herein.
