PAGE 1 OF 5 MOHAVE COUHTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-133 A RESOLUTION MODIFYING THE ADOPTED SOUTH MOHAVE VALLEY AREA PLAN TO ALLOW FOR COMMERCIAL MANUFACTURING USES IN THAT PORTION OF SECTION 14 LOCATED WEST OF HIGHWAY 95, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHA VE VALLEY, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to modify the adopted South Mohave Valley Area Plan, to allow for commercial manufacturing uses in that portion of Section 14 located west of Highway 95, Township 19 North, Range 22 West, in the South Mohave Valley area, and WHEREAS, the Planning and Zoning Commission is required to recommend to the Board of Supervisors a County land use General Plan which is designed to conserve natural resources, to insure efficient expenditure of public funds, and promote the health, safety, convenience, and general welfare of the public, and WHEREAS, Section 14 is bounded on the north by Bullhead City. The portion of Section 14 being evaluated is bounded by Highway 95 on the east, Sterling Road on the north and Arcadia Lane on the west. P. 2 OF 2046 PG 5 773 (FEE~92-24083) SK Resolution No. 92-133 Page 2 WHEREAS, current land use records indicate nine (9) lots are occupied. The current area plan indicates five (5) of these lots are designated for commercial use and three (3) lots fronting Highway 95 have been zoned C-2H (Highway Commercial). An approved single family subdivision exists directly to the north in Bullhead City. An El Paso Gas Pipeline easement exists within the Sterling Road right-of-way. Section 15 to the west has approximately twenty (20) acres designated and zoned for C-MO (Commercial Manufacturing/Open Lot Storage) uses which would border the southern part of the area under consideration, and WHEREAS, the applicant who initiated this request owns two (2) lots on the northern edge of this section and desires a C-MO land use designation. A public meeting to gather input from property owners in the section was held on February 19, 1992 at the Fort Mohave Elementary School on Joy Lane. Twel ve people were in attendance including the applicant and his representative. No opposition was expressed from those in attendance. Approximately nine lot owners have indicated their desire to also have their property designated for potential commercial land uses, and Co WHEREAS, the location of this proposed commercial use will have a profound impact on traffic patterns and overall traffic safety. The proposed access is at the top of the slope of the hill as traffic enters the county area and additional traffic . Resolution No. 92-133 . Page 3 could pose a safety hazard. PAGE 3 OF 5 BK 2046 PG 774 (FEE~92-24083) Consequently, the planning staff asked for comments from Arizona Department of Transportation (ADOT) indicating their concerns and possible steps to mitigate. In addition, the planning staff asked El Paso Natural Gas for comments regarding the improvement of proposed access to this site. Bullhead City Planning & Building Department comments: 1. The General Plan Update and zoning regulations show the area adjacent to the subject tract as various types of single family and multiple family residential. We do not anticipate a change in these designations. 2 . The site inspection results in the most significant findings. The topography of the general area is definitely varied and a natural buffer exists along Sterling Road. This buffer is created by distinct changes in elevation between the north and south sides of Sterling Road. Grading along this section line should be kept to a minimum to protect the current separation. r: I I , ". ../ 3. Also in regards to topography, Sterling Road does not appear to be a viable ingress/egress into either area. Other alternatives should probably be considered. In summary, we believe that the elevation differences created by the topography of the area will act as a buffer. A natural separation will occur between what develops within the city limits and that which results immediately adjacent in the county. Thus, upon further consideration of the proposal, we do not have any objections to the request for C-MO. Arizona Department Of Transportation comments: " . .. ADOT has no objection to this area plan amendment but we do have concerns regarding truck and/or' other commercial access to S.R. 95. . .-:~ Our focus will be on implementing local street systems to limit highway access to intersecting streets rather than individual access for each business site. We encourage the applicants to meet with us as soon as possible in order to facilitate access permits." . . PAGE ~ OF 5 BK 2046 PG 775 (FEE~92-24083) Resolution No. 92-133 Page 4 WHEREAS, the Planning and Zoning Commission at their meeting on April 8, 1992 did recommend APPROVAL of the amendment to the South Mohave Valley Area Plan to allow for commerc ial manufacturing open lot storage uses in a portion of Section 14, Township 19 North, Range 22 West lying west of Highway 95 contingent upon the following conditions: 1. Use and development of Sterling Road shall be coordinated with El Paso Natural Gas Company and ADOT. 2. Efforts shall be made to retain the natural buffer between Sections 10 & 14. If necessary additional man made buffers may need to be established. 3. The amendment will be in effect for all of Section 14 lying west of Highway 95. 4. Establishment of a special building setback of fifty (50') feet from the centerline of Sterling, Dunlap and Gardner Roads and forty (40') feet from the centerline of Arcadia Lane. This setback will provide for possible right-of-way expansion of roads within the section to sixty (60') feet. 5. Further study with ADOT be initiated to determine the best traffic access to this area before further commercial development occurs. 6. This information be considered in the current County plan update. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on April 19, 1992, and in the Mohave Valley News, and posted April 17, 1992 as required by Arizona Revised Statutes and Mohave County Zoning Regulations. .. .. p i ' l::2 . ~~ . . Resolution No. 92-133 PAGE 5 OF 5 BK 2046 PG 776 (FEE~92-24083) Page 5 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992, approved and adopted this amendment to the South Mohave Valley Area Plan as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
