A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY
SETTING FORTH THE REZONING OF A PORTION OF THE N~ NW~ NW~ SECTION
21, TOWNSHIP 14 NORTH, RANGE 21 WEST, FROM: C-2 (GENERAL
COMMERCIAL) ZONE, PROPOSED TO BE: C-2H (HIGHWAY COMMERCIAL) ZONE,
LOCATED IN THE LAKE HAVASU AREA, MOHAVE COUNTY, ARIZONA
RESOLUTION NO. 92-132
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 4, 1992, a public hearing was
conducted to determine whether approval should be granted to Gale
Marsh of Lake Havasu City, Arizona, for a zone change from
existing C-2
(General Commercial)
zone to C-2H (Highway
Commercial) zone, located west of London Bridge Road, three
hundred eighty (380') feet south of Chenoweth Drive in the Lake
Havasu City area, and
WHEREAS, this is a zoning violation case. The applicant is
proposing this rezone to cover some existing uses that are not
specifically covered under the existing C-2 (General Commercial)
zone, and
WHEREAS, the development to the north is a fire station and
boat works which is operating without County permits. A variety
of storage yards and R-V parks are developed to the south. Other
commercial and R-V parks are proposed east of London Br~dge Road,

WHEREAS, the zoning proposed is an upgrade of an existing C-
2 (General Commercial) Zoning District, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on April 8, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the

The applicant comply with all applicable prov~s~ons of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
THE FOLLOWING ITEM APPLIES TO THE ENVIRONMENTAL
REQUIREMENT.
2. Applicant submit proof of hookup to an approved sewage
treatment facility and community water system.
THE FOLLOWING ITEMS APPLY TO TRANSPORTATION RELATED
REQUIREMENTS.
3. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.

The applicant shall pave all driveway access and
parking in accordance with Mohave County Standard
Specification #171, or better. This may be
accomplished in phases after appropriate change of use
and building permits are obtained, occupancy approved
by the Building Official, and before the units are
commercially occupied.
THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS.

It should be noted that there are existing structures
on this site and these structures must be modified if
the applicant desires to establish businesses within
the existinq storaqe units. Existing businesses must
be brought into conformance with current UBC standards
for the business use as approved by the Moha~e County
Chief Building Official.

6. Any remainder of the lot not used for development shall
be maintained free of debris and the vegetation
controlled to minimize potential fire hazards.
Grasses /weeds shall be cut regularly to assure less
than eight (8") inches of growth. If crushed rock is
used then the soil shall be maintained in a weed free
condition.

Any permitted open lot storage must be related to or be
an accessory to the primary business. The storage area
shall be covered with a dust-proof surface. If crushed
rock is used for the dust-proof surface then the soil
shall be maintained in a weed free condition. Any open
lot storage shall be completely enclosed by a view-
obscuring fence which extends two (2') feet above the
highest item to be stored, with a minimum of six (6')
feet and a maximum of eight (8') feet in height.
Fencing shall display no advertising.

The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being June
3, 1992, as per ARS 11-829E.

I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on April 19, 1992, and in The Havasu
Herald, and posted April 16, 1992 as required by Arizona Revised

Statutes, and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, May 4, 1992 approved this
Amendment to the Mohave County Zoning Regulation through the
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
