RESOLUTION NO. 92-131 A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A SINGLE FAMILY RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, ON A PORTION OF SECTION 33, TOWNSHIP 41 NORTH, RANGE 15 WEST, LOCATED IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held April 6, 1992 a public hearing was conducted to determine whether approval should be granted to Marshall and Sharon Duffield of Salt Lake City, Utah, for a Zoning Use Permit (ZUP) for the establishment of a single family residence in a C-2 (General Commercial) zone in Section 33, Township 41 North, Range 15 West, located in the Arizona Strip area, and WHEREAS, Section 33 is located approximately one and one- half (1. 5) miles north of the Littlefield - I-IS interchange. Access from old Highway 91 is via McKnight Road east approximately three hundred (300') feet on the south side of the road to the subject property, and WHEREAS, review of floodplain map #040058-0025B indicates this area to be clear of a designated floodplain. The site is currently vacant. Surrounding land uses consist of a mobile home park to the north, Beaver Dam Oasis subdivision to the:northwest . .. PA~ 2 OF 3 BK 2046 PG 766 (FEE~92-24081) Resolution No. 92-131 Page 2 and the remainder being mostly vacant land. This area was zoned commercial some time ago and has not been fully utilized. There are a number of residential uses within the immediate area. The potential for commercial uses at this location is limited, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable prov~s~ons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. 3. A special building setback twenty-five (25') feet be established from the current right-of-way boundary of McKnight Road to provide for future expansion. 4. If construction or use has not commenced within one (1) year of Board approval of the zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 6 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. . . PAGE 3 OF 3 BK 2046 PG 767 (FEE~92-24081) Page 3 Resolution No. 92-131 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 19, 1992, and in The Daily Spectrum and Desert Echo, and posted April 17, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Zoning Regulation by granting this Zoning Use Permit as recommended by the Mohave County Planning and zoning Commission, subject to the conditions outlined herein.
