PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC iCROmMEO 3' , J \\O\MVf ~ ~ o~ RESOLUTION NO. 92-130 ~~~ ~ ~: .. -'-"-,;u:llI{) :'" ~.~ ~"~ J::o. ~. .., , ~ OoI.';IIUI ~ :'JQ 1864 ~~ A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATIONS BY SETTING FORTH THE REZONING OF A PORTION OF THE SE~ NE~ AND SW~ NE~ SECTION 8, TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM: A (GENERAL) ZONE, PROPOSED TO BE: A-R (AGRICULTURAL RESIDENTIAL) ZONE, LOCATED IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to determine whether approval should be granted to Farold B. and Norma Christiansen of Littlefield, Arizona, for a zone change from existing A (General) zone to A-R (Agricultural Residential) zone, located south of the Littlefield-Interstate 15 interchange in the Arizona Strip area, and WHEREAS, the applicants, Farold and Norma Christiansen, have acquired a one-half (.5) acre parcel of land in the Littlefield area that lies just south of County Highway, "Old" State 91, and WHEREAS, the zoning in this area is "A" ( General) zone. This zone was established in 1967 and requires a minimum of five (5) acre parcels. The proposal to go to R-1 (Single Family Residential) zoning, as originally requested, in the midst of an "A" zone is an instance of "spot" zoning. However, most land parcels in this area are less than five (5) acres in size. Many are served by the Littlefield Water Company, and . PA' 2 OF BK 20~6 PG 3 763 (FEE~92-24080) Page 2 Resolution No. 92-130 WHEREAS, the applicant was requested, by separate letter, to contact other land owners in Section 8, south of Interstate 15, requesting this Littlefield area be rezoned to A-R (Agricultural- Residential). Any existing parcels, less than one (1) acre, will be legal, nonconforming lots or parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the conditions: applicant understanding and accepting the following 1. The applicant comply with all applicable provlslons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. 3. All of Section 8 lying south of Interstate 15 be zoned A-R (Agricultural-Residential). 4. , i I I , I 1 j i 1 t I :1 I i I I I That any lots not meeting minimum lot size requirements be granted nonconforming status. 5. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being June 3, 1992, as per ARS 11-829E. If' these conditions are not met wi thin one ( 1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. 6 . _.- i 1 1 ~ I I i 1 . , 3 OF BK 2046 PG 3 764 (FEE~92-24080) Page 3 Resolution No. 92-130 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 19, 1992, and in The Daily Spectrum and Desert Echo, and posted April 17, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Zoning Regulation through the change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
