PAGE 1 OF 5 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 18, SECTION 7, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: c- 2H/8A (HIGHWAY COMMERCIAL/EIGHT ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1992, a public hearing was conducted to determine whether approval should be granted to Donald Kopczick and Patricia & Larry Brown of Glendale, California, for a zone change for Parcel 18, Section 7, township 21 North, Range 18 West from existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to C-2H/8A (Highway Commercial/Eight Acre Minimum Lot Size) zone, located seven hundred (700') feet west of Colorado Road north of Highway 68 in the Golden Valley area, and WHEREAS, Section 7 is located approximately six and one- quarter (6.25) miles west of the Highway 68 & 93 junction and is bisected by Highway 68. The subject property is approximately seven hundred (700') feet west of Colorado road lying north of Highway 68 and is bounded by Highway 68, Lowell & Lochiel Roads and Supai Drive. Access to the property from Highway 68 is via Colorado Road north approximately eight hundred (800') feet to . p~ 2 OF 5 8K 2032 PG 170 (FEE~92-18016) Resolution No. 92-113 Page 2 Supai Drive, thence west approximately seven hundred (700') feet on the south side of the street, and WHEREAS, review of floodplain map #040058-2325B indicates this area to be clear of a designated floodplain. The site is currently vacant. Surrounding land uses consist of mostly vacant land. This northern portion of Parcel 18 was created by the traversing of Highway 68 and became nonconforming when the A- R/10A zoning was established via Resolution P&ZC: 87-25. Originally the applicant desired to change the minimum lot size, he has since requested a change to commercial. This request is in conformance with the Golden Valley Area Plan, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provlSlons of Sections 25, 26, 27, and 31 of the Mohave County zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. NOTE:THE FOLLOWING ITEMS APPLY TO PARCEL PLAT REQUIREMENTS. 2. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. This parcel shall meet or exceed eight (8) acres exclusive of road easements or rights-of-way. . p~ 3 OF 5 BK 2032 PG 171 \FEE~92-18016j Page 3 Resolution No. 92-113 4. The establishment of a minimum lot size based on the size of the parcel per the recorded Parcel Plat. 5. The Parcel Plat shall show any surface drainage or FEMA flood zones. 6. The Board of Supervisors accept the ABANDONMENT of the existing fifty (50') foot roadway easement along the north boundary, being the south fifty (50') feet of Supai Drive, and the one hundred (lOa') foot easement along the south boundary of this parcel, being the north half of Highway 68, to be replaced by the DEDICATION of a twenty (20') foot right-of-way along the north boundary, one hundred (100') foot right-of- way along the south boundary. In addition, the DEDICATION of a thirty (30') foot right-of-way along the east and west boundaries and twenty (20') foot radii at all corners of this parcel. In addition, the GRANTING of eight (8') foot PUEs along all boundaries. This abandonment shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statements and dedication/granting be shown on the Parcel Plat. 7 . No building/zoning/environmental permits issued until after Parcel Plat recordation. shall be NOTE:THE FOLLOWING REQUIREMENTS. ITEM APPLIES TO ENVIRONMENTAL 8. Applicant supply proof of hookup to an approved sewage treatment facility and community water system. NOTE:THE FOLLOWING 5 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 9. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. . 10. A one (1') foot vehicle non-access easement shall be established along the south boundary of this parcel contiguous to Highway 68' s northern right-of-way. A six (6') foot block wall shall be required along this easement. (Commission would consider an engineered design to assure lot protection and non-access in lieu of a block wall.) 11. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or.better. . . Resolution No. 92-113 PAGE 4 OF 5 BK 2032 PG 172 (FEE;92-18016) Page 4 12. The owner/developer shall pave Lowell Road, Supai Drive and Lochiel Road as they are contiguous to this property. The paving of the aforementioned roads shall be in accordance with Mohave County Standards 101.10A or better and shall be placed on the center line of roadway right-of-ways in a width and design as approved by the County Engineer and coordination with ADOT for access to Highway 68. 13. The applicant obtain required ADOT permits for access to Highway 68 if applicable. NOTE:THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 14. That appropriate zoning/building/environmental permits be obtained. 15. That a buffer, in the form of a six (6') foot block wall shall be required along the entire boundary where commercial uses and zoning abut residential zones and existing residential units. (Commission would consider an engineered design to assure lot protection and non- access in lieu of a block wall.) 16. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. 17. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Fencing shall display no advertising. 18. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 22, 1992, and in the Mohave Valley Daily News, and posted March 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
