PAGE 1 OF '3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He ~~~..}~~ RESOLUTION NO. 92-112 A RESOLUTION SETTING FORTH APPROVAJJ OF A ZONING USE PERMIT FOR ESTABLISHMENT OF AN ABOVE GROUND PROPANE TANK FOR RETAIL SALES IN A C-2H (HIGHWAY COMMERCIAl.) ZONE, ON LOT 10, BLOCK E, GOLDEN SAGE RANCHOS UNIT 65, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held April 6, 1992 a public hearing was conducted to determine whether approval should be granted to Henry Shaw of Kingman, Arizona, for a Zoning Use Permit (ZUP) for establishment of an above ground propane tank for retail sales in a C-2H (Highway Commercial) zone on Lot 10, Block E, Golden Sage Ranchos Unit 65, occupying the northeast corner of Marana Road and Highway 68 in the Golden valley area, and WHEREAS, Section 9 is approximately five (5) miles west of the Highway 68 and 93 junction and is bisected by Highway 68. The subject property occupies the northeast corner of Highway 68 and Marana Road, and WHEREAS, review of floodplain map #040058-2325B indicates this area to be outside of a designated floodplain. The property is currently occupied by a hardware store. Surrounding land uses consist of commercial uses along Highway 68. The res idential '- . This property is located within the valley Pioneer Water Company District and the Mohave County Building Code area, and WHEREAS, the applicant desires to establish a one thousand ( 1,000) gallon propane tank as part of their retail operation. Because the applicant is selling the propane as part of a commercial use, a Zoning Use Permit (ZUP) is required. The current ordinance does not allow the storage of flammable fuels in a commercial zone without obtaining a ZUP. This process ensures proper safety, health and welfare standards are met, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on March 11, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provlslons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/enviromnental permits be obtained. 3. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. ..... -< - ..". . . 30F BK 2032 PG 3 168 (FEE~92-18015) Page 3 Resolutin No. 92-112 5. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 22, 1992, and posted March 20, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
