A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR A
MOBILE' HOME AS A SALES OFFICE AND TEMPORARY OPEN LOT STORAGE FOR
HIGHWAY CONSTRUCTION EQUIPMENT LOCATED IN AN A-R/I0A
(AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE ON A
PORTION OF THE N~ PARCEL 46, SECTION 10, TOWNSHIP 21 NORTH, RANGE
18 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held April 6, 1992 a public hearing was conducted
to determine whether approval should be granted to Jim Kuden of
Escondido, California, for a Zoning Use Permit (ZUP) for a mobile
home-as a sales office and temporary open lot storage for highway
construction equipment located in an A-R/10A (Agricultural
Residential/Ten Acre Minimum Lot Size) zone in a portion of the
N~ Parcel 46, Section 10, Township 21 North, Range 18 West,
occupying the southwest corner of Aztec Road and Highway 68 in
the Golden Valley area, and
WHEREAS, Section 10 is located approximately three and one-
quarter (3.25) miles west of the Highway 68 & 93 junction and is
bisected by Highway 68.
The subject property occupies the
southwest corner of Aztec Road and Highway 68 with access to the
property being on Aztec Road, and

WHEREAS, review of floodplain map #040058-2325B indicates a
portion of this area to be within a designated floodplain. The
site is currently vacant but is also designated to be part of
Aztec Junction, Tract 3019.
Surrounding uses consist mostly of
vacant land with Aztec Junction, Tract 3019-A to the south. This
property is located within the Valley pioneer Water Company
District and the Mohave County Building Code area, and
WHEREAS, the applicant desires to establish a mobile home as
a sales office for Aztec Junction. He also desires to establish
a temporary open lot storage area for highway construction
equipment.
The
applicant
has
arrangements with Arizona
Department of Transportation
(ADOT)
to store construction
vehicles and fuel on the property while expansion of Highway 68
is in progress.
A similar situation is occurring during the
Highway 93 improvements and a ZUP was obtained to allow temporary
open lot storage of heavy equipment, and
WHEREAS, a public hearing before the Mohave County Planning
and zoning Commission on March 11, 1992 and did generate a
recommendation of APPROVAL of the requested Zoning Use Permit
contingent upon the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.

NOTE:THE FOLLOWING ITEMS APPLY TO THE STORAGE AREA.
2. This permit shall be for a !emporary permit for a one
year period with provision for extensions of one year.
3. At the conclusion of ADOT Highway 68 Project the
applicant shall contact Commission staff if ADOT wishes
to use this parcel as storage of equipment for another
project of similar nature and the applicant wishes to
have this ZUP extend to cover the time frame of the
additional project or subsequent projects.
4. Appropriate zoning/building/environmental permits be
obtained.
5. At the expiration of this approval the property shall
revert to original zoning and condition.
6. Fuel storage facilities shall meet proper setbacks as
provided in Uniform Building Code.
NOTE:THE FOLLOWING ITEMS APPLY TO THE SALES OFFICE.
-7. This permit shall be a temporary permit for a one year
period with provision for one extension of one year.
8. The site shall have appropriate landscaping for the
surroundings and shall provide temporary adequate off-
street parking as provided in the site plan.
9. At the expiration of this approval the property shall
revert to original zoning and condition except such
improvements that can be incorporated into the parcel's
future use i.e. sidewalk, PUE's, paved parking, access.
10. The mobile home shall have an affixed HUD label.
11. The mobile home shall be used as a sales office only
and not as a residence or watchman's quarters.
12. The access and parking area be paved if the sales
office use extends beyond one (1) year from the date of
Board approval.
13. Appropriate zoning/building/environmental permits be
obtained.
14. Appropriate signage permits be obtained.

NOTE:THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS.
15. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
16. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
17. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on March 22, 1992, and posted March 20,
1992 as required by the Arizona Revised Statutes and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, April 6, 1992 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
