PAGE 1 OF NOHAVE COUNTY BOARD OF SUPERVISORS RECORDIHG FEE 0.00 He RESOLUTION NO. 92-189 A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF LOT 3, BLOCK P, GOLDEN SAGE RANCHOS UNIT 56, SECTION 7, TOWNSHIP 21 NORTH, RANGE 17 WEST, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-2H (HIGHWAY COMMERCIAL) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1992, a public hearing was conducted to determine whether approval should be granted to Orval Dean Carr of Kingman, Arizona, for a zone change from existing C-2 (General Commercial) zone to C-2H (Highway '\ Commercial) zone, located on Highway 68, two hundred (200') feet east of Kofa Road in the Golden Valley area, and (' (~S, Golden Sage Ranchos Unit 56 is immediately adjacent -'-- to the Highway 68 & 93 junction anp i-l? bisected by Highway 68. The subject property is currently ~cc'essed from Highway 68 via Kofa Road north to a frontage roaa the~ east approximately two hundred (200') feet, and WHEREAS, review of floodplain map #040058-2325B indicates this area to be clear of a designated floodplain. The site is currently occupied by a commercial building that is not actively being used. Surrounding land uses consist of a commercial '. . Resolution No. 92-189 Page 2 PAGE 2 OF ~ BK 2059 PG 206 (FEE~92-29~89) business to the west and mostly vacant land. The applicant desires to establish an auto restoration/car sales operation. The applicant has some cars located on his residential lot and needs to upgrade this lot to move a business onto and bring his residential lot into compliance, and WHEREAS, this request stems from a zoning violation case, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable prov~s~ons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. NOTE: THE FOLLOWING APPLIES TO ENVIRONMENTAL REQUIREMENTS. 2. Applicant submit proof of hookup to an approved sewage treatment facility and water system. NOTE: THE FOLLOWING ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. ADOT had the following comments: - Drawings submitted indicate that there is an access road by ADOT. Driveway connections to paved ADOT roads must be paved. - ADOT access permit is required... - Size and placement of driveway will be according to ADOT standard. . . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. NOTE: 5 . 6. 7. j I ; ,I ~ 1 ~ 'I I 1 ~ I '1 'I 11 ;1 THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. That appropriate zoning/building/environmental permits be obtained. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Fencing shall display no advertising. 8 . The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being July 2, 1992, as per ARS 11-829E. 9. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ..... ~.. .. . . Resolution No. 92-189 Page 4 PAGE + OF 4 BK 2059 PG 208 (FEE~92-29489) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1992 approved this Amendment to the Mohave County Zoning Regulation through the change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
