A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY
SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE
ESTABLISHMENT OF AN OFF PREMISE SIGN IN AN A-R (AGRICULTURAL
RESIDENTIAL) ZONE ON PARCEL 249, SECTION 11, TOWNSHIP 21 NORTH,
RANGE 19 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held June 1, 1992 a public hearing was conducted
to determine whether approval should be granted to U.S. General
Homes, Inc. of Littlefield, Arizona, for a Zoning Use Permit
(ZUP) for the establishment of an off premise sign in an A-R
(Agricultural Residential) zone on Parcel 249, Section 11,
Township 21 North, Range 19 West, occupying the northeast corner
of Milky Way and Highway 68, located in the Golden Valley area,
and
WHEREAS, Section 11 is located approximately eight and one-
half (8.5) miles west of the Highway 68 & 93 junction and is
bisected by Highway 68.
The site occupies the northeast corner
of Milky Way and Highway 68, and
WHEREAS, the site is currently vacant and surrounding land
uses consist of a vacant commercial site south of the Highway and
Crystal Springs approximately one-quarter (.25) mile to the

north. The applicant desires to establish an off premise sign to
function as a real estate/directional sign for properties in
Crystal Springs further north which are accessed from Highway 68
via Milky Way, and
WHEREAS, current regulations require that off premise signs
be located in commercial zoning.
Signs on Highway frontage can
be in C-2 zoning.
ADOT also requires off premise signs having
highway frontage to be in commercial zones, and
WHEREAS, this item was continued from the March 11, 1992 P&Z
meeting for staff to determine if a sign permit had been granted.
Staff found that Permit #K92-158 was not issued and/or approved.
The permit was being held until after this request has been acted
upon by the Board of Supervisors, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on May 13, 1992 and did generate a
recommendation of APPROVAL of the requested Zoning Use Permit
contingent upon the following conditions:
1.
The request does meet the criteria as set forth in the
ordinance for construction signs (Section 31.E.l.).
The applicant understands that if the Commission and/or
the Board grants the ZUP based on special
circumstances, the applicant will still have to acquire
an ADOT permit.

3. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Section 27. P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
4. That appropriate zoning/building/environmental permits
be obtained.
5. The Planning staff contacted ADOT and learned that ADOT
will not grant a permit to an off premise sign in a
noncommercial zone. However, enforcement of this rule
may be delayed until after Highway 68 improvements are
completed.
6. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
7. This Zoning' Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.

If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992
as required by the Arizona Revised Statutes and the Mohave County
Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 1, 1992 approved this
Amendment to the Mohave County Zoning Regulation by granting this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
