A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE REZONING
OF LOT 113, BERMUDA PLANTATIONS UNIT 2, FROM: R-E (RESIDENTIAL
RECREATION) ZONE, PROPOSED TO BE: C-2/25M (GENERAL
COMMERCIAL/TWENTY-FIVE THOUSAND SQUARE FOOT MINIMUM LOT SIZE)
ZONE, LOCATED IN THE sou'rH MORAVE VALLEY AREA, MORAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 1, 1992, a public hearing was
conducted to determine whether approval should be granted to J.P.
, Mallis, all of Garden Grove, California for an extension of time
and Mary Gerami, Robert Stephens, and Leonard J. & Mary T.
for the rezoning of Lot 113, Bermuda Plantations Unit 2, from the
existing R-E (Residential Recreation) zone to C-2/25M (General
CommerCial/Twenty-five Thousand Square Foot Minimum Lot Size)
zone, occupying the southeast corner of Vacation Drive and Harbor
Avenue, located in the South Mohave Valley area, and
WHEREAS,
Bermuda
Plantations,
Unit
#2,
is
located
approximately thirteen (13) miles south of Bullhead City in the
vicinity of Needles, California.
The subject property can be
accessed
from
the Highway
95 via Harbor Avenue
south
approximately three-quarters (.75) of a mile to the southeast
corner of Harbor Avenue and Vacation Drive, which this parcel
occupies, and

WHEREAS, review of flood plain map #040058-261SC indicates
this area to be in a FEMA designated flood zone.
Surrounding
land uses consist of mostly residential with some vacant land.
The applicant wishes to establish a strip mall with laundromat
facilities. Research indicates a large quantity of commercially
zoned property already exists in this section.
Bermuda Dunes,
Bermuda village, Bermuda Plantation and South Valley Park
subdivisions all have acreage zoned for commercial uses, most of
which show on land use maps as vacant, and
WHEREAS, at their meeting of November 5, 1990, the Board of
Supervisors returned this case to the Commission at the request
of the applicants representative on the basis that the
representative was not in attendance at the Commission meeting to
defend the applicant's viewpoint in regards to this case. At the
November 14, 1990 P&Z meeting the Commission continued this item
in order to consider it in conjunction with a neighboring rezone
of Lot 105.
The Commission expressed an interest in allowinq
Harbor Avenue to become commercial as it extends south to
Needles, California, and
WHEREAS, the request for rezone was granted with the
following conditions via Board of Supervisors Resolution 91-8:
1. The zoning for this parcel be C-2/2SM (General
Commercial/Twenty-five Thousand Square Foot Minimum Lot
Size) zone.

2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County Zoning
Regulations.
3. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
4. The two parcels existing on Lot 105 (10A & 10B) be
combined through the parcel plat procedure.
5. The establishment of a minimum lot size based on the
size of the parcel per the recorded Parcel Plat.
6. The Parcel Plat shall show any surface drainage.
7. That the Board of Supervisors accept the dedication of
a twenty (20') foot radius at the Harbor Avenue and
Vacation Drive intersection shall be set. An eight
(8') foot PUE on the above mentioned roads shall be
included as they are contiguous to this property. This
shall be approved through the recording of the
resolution authorizing this zone change and that the
dedication statement and dedication be shown on the
Parcel Plat.
8. An additional seventeen (17') foot building setback
along Harbor Avenue as it is contiguous to this parcel
shall be provided for potential right-of-way expansion.
9. The development shall have adequate parking facilities.
10. Arizona Department of Water Resources approves the
water supply and distribution system.
11. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.
12. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.

14.
Levee Drive be paved as it is contiguous to this parcel
as well as all driveways and parking. All paving be
paved in accordance wi th Mohave County Standard
Specification #171 or better, and that such paving be
completed within ninety (90) days of the certification
of occupancy granted the building.
Building/zoning permit(s) shall be obtained.

form of a six (6') foot block
along the entire boundary where
zoning abut single family
16. A one (1') foot vehicle non-access easement and
physical barrier a minimum of three (3') feet in height
will need to be provided on the perimeter of the
development frontage Harbor Avenue for this project as
access should be on Levee Drive.
17. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
February 7, 1991, as per ARS 11-829E.
18. I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the applicants requested an extension of time based
on economic hardships.
The applicant also requests that the
conditions of approval outlined in Resolution 91-8 be waived, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 13, 1992, the Commission
recommended conditional APPROVAL of the requested extension of
time with the applicants understanding and accepting the
following conditions:
1. The applicants comply with all provisions of Resolution
91-8.

2. The extension of time be granted to February 7, 1993.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on May 17, 1992, and in the Mohave valley
Daily News, and posted May 15, 1992 as required by Arizona
Revised Statutes, and the Mohave County zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 1, 1992 approved the
granting of this extension of time for a conditional Zone Change
as recommended by the Mohave County Planning and zoning
Commission and outlined herein.
