A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY PLAN OF THE HIGHLANDS, TRACT 4091, A SUBDIVISION OF A
PORTION OF THE W~ SECTION 7, TOWNSHIP 18 NORTH, RANGE 21 WEST,
LOCATED IN THE SOUTH MORAVE VALLEY AREA; MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 1, 1992, a public hearing was
conducted to determine whether approval should be granted to
HOLPAL California Ltd., Partnership, Los Angeles, California, and
being represented by James N. Ognisty, Dempsey Construction
Corporation of Mammoth Lakes, California, for an extension of
time for the approved preliminary plan of THE HIGHLANDS, Tract
4091, a subdivision in a portion of the W~ Section 7, Township 18
North, Range 21 West, located in the South Mohave Valley area,
and
WHEREAS, the owner/developer of this tract is HOLPAL
California Ltd., Partnership, Los Angeles, California. The
engineering firm responsible for the preparation of the drainage
report and design of this subdivision is Holland West, Inc., of
Englewood, Colorado, and
WHEREAS, the submitted preliminary plan depicts three
hundred twenty (320) acres subdivided into seven hundred seventy

(770) units. The minimum lot size of 7,500 square feet, and the
maximum lot size is 10,000 square feet, for a density of 2.5
units per acre, and
WHEREAS, the revised preliminary plan for this tract was
approved by the Mohave County Board of Supervisors on April 2,
1990, via
Resolution 90-77.
Article 3.10-1 states "Upon
application to the commission and prior to the expiration, of the
time limit, extensions in increments of one (1) year may be
granted by the Board if the subdivider is actively processing the
Final Plat.
If such action is not taken then all proceedings
relating to the plat shall be terminated", and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 13, 1992, the Commission
recommended conditional APPROVAL of the requested extension of
time with the applicant understanding and accepting the following
conditions:
1. In the letter dated April 9, 1992, Mr. James N.
Ognisty, Vice President for Dempsey Construction
Corporation request an extension of time. The
developer/owner states, "We have been delayed in
processing the final maps for the subdivision due to
conflicts with local water companies. This problem has
now been resolved and we expect the Corporations
Commission to issue a CC&N to the Bermuda Water Company
in a short period of time."
2. This extension of time will be in effect until April 2,
1993.

3. As provided in Article 3.10-1 "..., extensions in
increments of one (1) year may be granted by the Board
if the subdivider is actively processinq the Final
Plat. If such action is not taken then all proceedinQs
relatinq to the plat shall be terminated
At the request of Roqer Esquerra, cartoqrapher, the Commission
recommends Final plat and Parcel Plat Boundaries be a triple wide
line as the 1/8" blue line border obscures dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on May 17, 1992, and in the Mohave valley
Daily News, and posted May 15, 1992 as required by Arizona
Revised Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 1, 1992 approved the
granting of this extension of time for the preliminary plan of
DESERT COVE, Tract 4094, as recommended by the Mohave County
Planning and zoning Commission and outlined herein.
