Stoddard of Littlefield, Arizona, for a Zoning Use Permit (ZUP) for the establishment of a mobile home park in an A-R (Agricultural Residential) zone in the NW~ Section 33, Township 41 North, Range 15 West, located in the Arizona Strip area, and WHEREAS, this property is located approximately four hundred (400') feet west of Old Highway 91 in the Beaver Dam Area. Access is provided by an existing, gravel, fifty (50') foot wide, right-of-way easement. There is one (1) home and several mobile homes on the subject property at this time. Beaver Dam Heights is a proposed one acre+ subdivision adjacent to the east of the subject property. The remaining adjacent property has been split into one acre or larger homesites. The property to the west slopes down twenty-five (25%) percent which is a drop of approximately eighty (80') feet, and . PA~ 2 OF 5 BK~059 PG 156 (FEE~92-29~77) Resolution No, 92-177 Page 2 WHEREAS, review of Floodplain map #040058-0025B indicates this area is not in a FEMA special flood hazard area, and WHEREAS, the property owner is requesting a Zoning Use Permit (ZUP) for a mobile home park. Sewage will be handled by a proposed joint septic system. Water will be provided by an existing well and proposed private water system. Electricity will be provided by Dixie Escalante Rural Electric Association, Inc. The size of the property is 9.48 acres. The requested density is approximately four (4) units per acre. These mobile homes will be for RENT only, and WHEREAS, the Planning Department received nine protest letters from adjacent property owners. There is a total 0 f fifteen (15) adjacent properties. At a meeting on April 16, 1992 with staff, the applicant and neighbors, three (3) protesters reversed their opposition with conditions. Several other protesters have indicated they would reverse their opposition if conditioned appropriately, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on May 13, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions which are understood and agreed upon by the applicant: . The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Special enforcement and attention will be given to compliance with regulations related to garbage, trash and collection and control of same, Compliance with Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant submit plans and reports in accordance with Section 27-I. of the Mohave County Regulations, or its successor, for review and approval by the Commission and Board of Supervisors. 3. These lots/spaces will not be for sale unless or until they have been approved as subdivided parcels by the Mohave County Board of Supervisors and have met all the requirements of the Mohave County Subdivision Regulations. The buffer, in the form of a six (6') foot block wall shall be required along the boundaries of this parcel except approved access points. In addition to the block wall trees will be planted every twenty-five (25') feet on the inside of the wall adjacent to the cliff area and maintained by the owner. 11, The appropriate zoning/building/environmental permits be obtained. 12. Appropriate sign permits be obtained. 13. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit, or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 1 14. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 15. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. NOTE: THE FOLLOWING ITEM APPLIES TO SPECIAL REQUIREMENTS AS REQUESTED BY ADJACENT PROPERTY OWNERS ~ 16. Plans for construction of the six (6') foot block wall will be submitted to the County Engineer within one (1) month of the Board of Supervisors approval of this ZUP. The County Engineer will review the plans as they relate to drainage considerations and the location. The wall will be placed on level with the mobile homes for buffering purposes. The construction of the wall will begin within one (1) month of the County Engineer's approval. (Applicants have agreed to the construction of this wall.) ., j~.... . . Per Section 27 of the Mohave County Zoning Regulations, this site plan will be placed on the Planning and Zoning Commission agenda for a public hearing, with recommendations forwarded to the Board of Supervisors. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 17, 1992, and in The Daily Spectrum and Desert Echo, and posted May 15, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. ;.. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, .: :-,..._.J at their regular meeting on Monday, June 1, 1992 approved this Amendment to the Mohave County Zoning Regulation by granting this Zoning Use Permit as recommended by the Mohave County Planning and zoning Commission, subject to the conditions outlined herein.
