PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF LOT 7, BLOCK A, LAKE MORAVE COUNTRY CLUB ESTATES UNIT 3, FROM: C-2/1A (GENERAL COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-2H/IA (HIGHWAY COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 4, 1992, a public hearing was conducted to determine whether approval should be granted to Verne Gillman of Kingman, Arizona, for a zone change from existing C-2/1A (General Commercial/One Acre Minimum Lot Size) zone to C-2H/1A (Highway Commercial/One Acre Minimum Lot Size) zone, located on the west side of Bank Street, 1,200 feet south of Northern Avenue in the Kingman area, and WHEREAS, Lake Mohave Country Club Estates Unit 3 is located approximately one and one-half (1.5) miles north of the I-40 & Andy Devine (Highway 66) interchange. The subject property is accessed from Highway 66 via Gordon Drive west approximately one and one-quarter (1.25) miles to Bank Street, thence north approximately 3,900 feet on the west side of the street, and WHEREAS, review of floodplain map #040058-2165C indicates this area to be clear of a designated floodplain. Surrounding land uses consist of mostly vacant land with a commercial use to the northwest and some businesses further north. The applicant desires to establish the storage of motor homes, boats and trailers, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 8, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. NOTE: THE FOLLOWING ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 2. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 3. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification *171, or better. NOTE: THE FOLLOWING ITEM APPLIES TO THE ENVIRONMENTAL REQUIREMENT. 4. The applicant supply proof of hookup to an approved sewage treatment facility and community water system. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 5. That pertinent building/zoning/environmental health permits be obtained. 6. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. .. -~... . . Page 3 Resolution No. 92-153 7. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Fencing shall display no advertising. 8 . The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being June 3, 1992, as per ARS 11-829E. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 19, 1992, and posted April 17, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 4, 1992 approved this Amendment to the Mohave County Zoning Regulation through the recommended by the Mohave County Planning and outlined herein.
