A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY
SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE
ESTABLISHMENT OF A SINGLE FAMILY RESIDENCE, WITH THE POTENTIAL
FOR COMMERCIAL USES AT A LATER DATE, IN A C-2 (GENERAL
COMMERCIAL) ZONE ON LOT 26, SUNHAVEN HOMESITES, SECTION 33,
TOWNSHIP 22 NORTH, RANGE 16 WEST, LOCATED IN THE KINGMAN AREA,
MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held May 4, 1992 a public hearing was conducted to
determine whether approval should be granted to Ivano Albino of
Kingman, Arizona, for a Zoning Use Permit (ZUP) for the
establishment of a single family residence , with the potential
for commercial uses at a later date, in a C-2 (General

Commercial) zone on Lot 26, Sunhaven Homesites, Section 33,
Township 22 North, Range 16 West, occupying the northeast corner
of Diagonal Way and Able Drive in the Kingman area, and
WHEREAS, Section 33 is located approximately one and one-
half (1.5) miles north of the 1-40 & Andy Devine (Highway 66)
interchange.
The subject property is accessed from Highway 66
via Diagonal Way, thence west approximately 350 feet to the
northeast corner of Diagonal Way and Able Drive, and

WHEREAS, review of floodplain map #040058-2165C indicates
this site to be clear of a designated floodplain.
The site is
currently vacant.
Surrounding land uses consist of mostly
residential with some vacant land.
There are a number of
residences to the north, west and south.
A commercial site is
directly to the east.
The site is occupied by an above ground
fuel tank used as a private refuel point for a trucking company.
The site is screened from the subject property.
The applicant
desires to establish a residence and allow for the provision for
concurrent commercial uses at a later date.
The proposed
commercial use is a building to teach dance and studio classes.

I ~~ It may be prudent to reevaluate this ZUP when the applicant is
ready to actually engage in the commercial use, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on April 8, 1992 and did generate a
recommendation of APPROVAL of the requested Zoning Use Permit
contingent upon the following conditions:
1. The applicant comply with all applicable prov1s10ns of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
2. That appropriate zoning/building/environmental permits
be obtained.
3. The mobile home shall have an affixed HUD label.

5. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
6. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
7 . I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on April 19, 1992, and posted April 17,
1992 as required by the Arizona Revised Statutes and the Mohave
County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, May 4, 1992 approved this
Amendment to the Mohave County Zoning Regulation by granting this
zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
