A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY
SETTING FORTH THE REZONING OF PARCEL 17, LAZY Y-U RANCH PRASE 1,
LOCATED IN SECTION 11, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM: A-
R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE)
ZONE, PROPOSED TO BE: A-R/9A AND A-R/19A (AGRICULTURAL
RESIDENTIAL/NINE AND NINETEEN ACRE MINIMUM LOT SIZE) ZONES,
LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 4, 1992, a public hearing was
conducted to determine whether approval should be granted to Greg
Ascroft of Scottsdale, Arizona, for a zone change from existing
A-R/36A (Agricultural Residential/Thirty-six Acre Minimum Lot
Size) zone to A-R/9A and A-R/19A (Agricultural Residential/Nine
and Nineteen Acre Minimum Lot Size) zones, located in the
northwest foothills of the Hualapai Mountains in the Kingman
area, and
WHEREAS, the subject property is located approximately four
(4) miles southeast of the corporate limits of the City of
Kingman, on Hualapai Mountain Road.
The subject property is
approximately two and on-half (2.5) miles southwest of Hualapai
Mountain Road and is accessed via Lazy Y-U Drive and Lazy Y-U
Loop.
A private road easement will provide access to the new
parcels. The roads on these easements have not been ac~epted by
the County for maintenance, and

WHEREAS, review of floodplain map #2350-3450 indicates this
area to be within Flood Zone C (area of minimal flooding). The
terrain is rugged mountain foothill country.
Well constructed
gravel base roads serve these properties. The site is currently
vacant and bordered on all sides by vacant land. The property is
currently zoned A-R/36A. The zone change is for two (2) parcels
of A-R/9A and one parcel of A-R/19A from this original forty (40)
acre parcel, and
WHEREAS, Lazy Y-U Ranch, Phase I is the division of three
(3) Sections plus eighty (80) acres, into fifty (50) parcels of
forty (40) acres or more each. The developers plan to divide an
additional six (6) Sections of land in the future, and
WHEREAS, according to the Arizona Real Estate Commission,
all roads are easements and as such, do not create parcel
divisions.
The road designation is designated as follows:
"easements shown... are perpetual in nature and are created for
ingress/egress, drainage and public utility purposes for the
benefit of each of the parcels and their owners and the public".
The project attorneys recommended this wording to accommodate the
public, and
WHEREAS, there is no specific Area Plan for this area, and
it is not within the Building Code Overlay area, and

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on April 8, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:
1. Two parcels are to be zoned A-R/9A (Agricultural-
Residential/Nine Acre Minimum Lot Size) and one parcel
be zoned A-R/19A (Agricultural-Residential/Nineteen
Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. Each parcel shall have legal access.
4. Any new ingress/egress easements shall also be Public
Utility Easements.
5. The Parcel Plat shall show any surface drainage and the
FEMA flood zones.
6. No building/zoning permits shall be issued until after
Parcel Plat recordation.
7. That appropriate zoning, building, environmental, and
floodplain permits be obtained.
8. That the owner satisfy adequate proof of ownership one
(1) week (April 27, 1992) prior to the Board of
Supervisors meeting of May 4, 1992.
9. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being June
3, 1992, as per ARS 11-829E.
10. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board,
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine

compliance with the schedule for development or cause
the property to revert to its former
classification in accordance with Arizona
Statutes Annotated, Title 11, Chapter 6, 11-832.

At the request of Roqer ESGuerra, cartoqrapher, the Planninq
Commission recommends Final Plat and Parcel Plat boundaries be a
triple wide line as the 1/8" blue line border obscures dimensions
on prints.
mIEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on April 19, 1992, and posted April 17,
1992 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, May 4, 1992 approved this
Amendment to the Mohave County Zoning Regulation through the
change in zoning as recommended by the Mohave County Planning and
zoning Commission and outlined herein.
