PAGE 1 OF 4 I'lOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-219 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN FOR FAIRWAY ESTATES, TRACT 4097-D, A SUBDIVISION OF A PORTION OF THE E~ NE~ SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on June 15, 1992, a public hearing was conducted to determine the final subdivision plan for FAIRWAY ESTATES, Tract 4097-D, located in the South Mohave Valley area, and WHEREAS, the owners/developers of this tract are Glen L. & Pearle A. Ludwig, San Bernardino, California. The engineer responsible for the preparation of 'the drainage report and design of this subdivision is Glen L. Ludwig, Ludwig Engineering, San Bernardino, California, and WHEREAS, reviews have been received from the County Engineer/Floodplain Administrator, Mohave County Health Department, Mohave Valley Irrigation and Drainage District, and the Arizona Department of Environmental Quality and considered or incorporated in the evaluation of this final tract, and "i I i I :j i i ! Resolution No. 92-219 PAGE 2 OF 4 BK 2061 PG 992 (FEEt92-J3332) Page 2 WHEREAS, this subdivision is located in the Mohave Mesa area, approximately one-half (.5) mile east of State Highway 95, and three (3) miles south of Bullhead City, and WHEREAS, the approval of this subdivision is based on the understanding of the Board of Supervisors that all streets within the subdivision will be constructed and paved with asphaltic concrete in accordance with Standard Specifications #171 and 101.10A or better; the streets will include curb and gutter on the interior streets; grading and drainage related improvements will be made as recommended by the design engineer in the drainage reports; arrangements will be made to extend underground electric and telephone service to each lot in accordance with Arizona Corporation Commission Regulations; all lots and street centerline monuments will be staked and monumented in accordance with standard specification No. 102; fire hydrants will be provided at locations prescribed by the Fort Mojave Mesa Fire Department; street name and regulatory signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as recommended by the design engineer; and as a CONDITION OF APPROVAL the owner/developer is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations, and l:.E_~ .i .! ., i ] - ~ 'j :J I 1 i I ~i ,'1 ~-i , ; -, -1 .;j , I -I -I i . . . PAGE 3 OF BK 2067 PG 4 993 (FEEt92-33332) Page 3 Resolution No. 92-219 WHEREAS, Mohave County has received Arizona Department of Environmental Quality approvals for the water and sewer systems. The assurances cover the cost of installation for these site improvements and Certificates of Approval to Construct have been obtained. NOW THEREFORE BE IT RESOLVED, that the Board approves the said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the Subdivision Questionnaire to the Real Estate Commission as required for approval of this tract by the Board. A copy of the draft and final report delivered to the Arizona Departmen-t of Real Estate shall be submitted to the County for library purposes. 2. The owner/developer shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report. 3. Comments in the letter dated May 21, 1992, from the Public Works Department shall be complied with prior to recording of the final plat. 4. Assurances for the improvement of those portions of Mt. View Road lying adjacent to this phase (D) shall be incorporated in the overall assurances for Tract 4097- D. All comments in the Public Works letter dated May 26, 1992, regarding Mt. View Road shall be complied with. 5. The signed original CC&R's are on file in the Planning and Zoning Department and will be recorded with the final plat. 6. An assurance and/or surety shall be provided in the amount of the approved cost estimate for all required site improvements. . ~_, t' 1 " J 'i I ;1 ., i 'I ,\ 1 -1 . . The final plat for Tract 4097-D including the Dedication shall be properly executed and/or ratified by all parties having any record title interest in the land being subdivided and included on this subdivision boundary. NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of or evidence that these conditions have been met together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County Departments and officials and cause the final plat to be recorded. NOW THEREFORE BE IT FURTHER RESOLVED, that the rezoning of these lots shall be granted as per Board of Supervisors Resolution No. 90-60. NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing has been met and published throughout this subdivision process and the public was afforded notice of this final action through advertisement of the Board of Supervisor's Meeting for this date.
