SETTING FORTH THE REZONING OF THE NE~ SECTION 28, TOWNSHIP 21
NORTH, RANGE 16 WEST, TO BE KNOWN AND SUBDIVIDED AS NORTH RIDGE
ESTATES II, TRACT 3044, FROM: A-R/10A (AGRICULTURAL
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: (S-
D)R-O/20M (SPECIAL DEVELOPMENT/SINGLE FAMILY RESIDENTIAL/MOBILE
HOMES PROHIBITED/TWEN1.'Y THOUSAND SQUARE FOOT MINIMUM LOT SIZE)
ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 1, 1992, a public hearing was
conducted to determine whether approval should be granted to Lee
Bruno and Jay Schritter of Kingman, Arizona, for a zone change
from the existing A-R/10A (Agricultural Residential/Ten Acre
Minimum Lot Size) zone to (S-D)R-O/20M (Special Development
Single Family Residential/Mobile Homes Prohibited/Twenty Thousand
Square Foot Minimum Lot Size) zone, located south of Cheyenne
Avenue, twenty-seven hundred (2,700') feet east of Seneca Street
in the Kingman area, and
WHEREAS, the proposed subdivision is located one-eighth
(1/8) mile north of Hualapai Mountain Road on Seneca Street and
one-half (.5) mile east on Cheyenne Avenue at the southeast
boundary of the Kingman City Limits. Access is provided to this
site from Hualapai Mountain Road via Seneca Street and Cheyenne

Avenue.
It is bounded by the City of Kingman on the North and
West and BLM on the south, and
WHEREAS, the site is currently vacant.
Surrounding land
uses consist of Hualapai Foothill Estates, Tract 3003 to the
north with a mixture of homes and vacant land to the remaining
sides.
The preliminary subdivision plan depicts 53.43 acres
divided into 64 lots having a minimum lot size of 20,000 square
feet and maximum of 78,000 square feet for an over all density of
1.20 lots per acre, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 13, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:
1.
Compliance with the Preliminary Plat
conditions stated in Resolution 92-156.

2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. In addition to compliance with Ordinance
87-1 (Dark Sky Ordinance).
3. The ZONING PLAN be approved for a (S-D)R-O/20M (Special
Development/Single Family Residential Mobile Homes
Prohibited/Twenty Thousand Square Foot Minimum Lot
Size) zone in accordance with Section 19 of the Mohave
County Zoning Regulations.

THE FOLLOWING 4 ITEMS APPLY TO THE SPECIAL DEVELOPMENT
ZONING REQUIREMENTS.
The owner accepts that whenever a "S-D" zone is
granted, each phase of stage of development of building
proposals shall be submitted to the planning staff, to
be evaluated and compared with the approved zoning plan
before any permits may be granted.

Any significant change (as determined by the Planning
Director - appealable to the Planning Commission) in
the approved zoning plan shall require a rehearing on
the change before the Commission, with a final
determination to be made by the Board.
Staff will maintain the most current approved ZONING
PLAN on file in the master zoning folder for reviews.
The use of this property may not be changed by the
owner/developer or subsequent owners as it is approved
unless subsequently approved by the Board in accordance
with Arizona Statutes Annotated, Title II, Chapter 6,
Section 11-832.
8.
That an S-D plan be submitted prior to the scheduling
deadline for the Board of Supervisors meeting at which
this item will be heard. The S-D plan shall delineate
lot size for all lots and also the actual usable lot
area of the lot shall be delineated.

Because of proximity of this tract to Kingman City and
it's provisions for horse privileges Staff feels this
tract should have similar regulations and
correspondence from the City concurs with this concept.
However, most of the lots within this tract do not meet
the minimum lot size required for animal privileges in
the City. Therefore, staff proposes the following
language:
9. All lots except Block 1, Lots 10, 14 & 15; Block 3,
Lots 1, 4 & 5 (as shown on the Final Plat) may have
animal privileges as delineated in the following
conditions.
10. Horse uses must be fenced and contained within the rear
fifty (50') feet of the lot.

11. All feed, tack and other equipment related to the care
of horses must be stored in an enclosed building.

For lots greater than 40,000 square feet: Two
horses may be maintained for private use only. Two
offspring up to the age of eight (8) months
allowed. Offspring must have State Transportation
identification.

13. For lots less than 40,000 square feet and greater than
20,000 square feet: One (1) horse may be maintained
for private use only. One (1) offspring up to the age
of eight (8) months is allowed. Offspring must have
State Transportation Card identification.
NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS.
14. Any remainder of the lots not used for development
shall be maintained free of debris and the vegetation
controlled to minimize potential fire hazards.
Grasses/weeds shall be cut regularly to assure less
than eight (8 It) inches of growth. I f crushed rock is
used then the soil shall be maintained in a weed free
condition.
15. Pertinent zoning/Building/environmental health permits
be obtained.
16. The minimum setbacks for the residential portion of
this development shall be the standard R-O setbacks as
described in the regulations.
17. The rezone shall become effective upon the recordation
of the Final Plat. li development is phased, then only
the zoninq for that phase shall become effective.
At the request of Roqer Esquerra, cartoqrapher, the Commission
recommends Final Plat boundaries be a triple wide line as the
1/8" blue line border obscures dimensions on prints.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992

as required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 1, 1992 approved this
Amendment to the Mohave County Zoning Regulation through the
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
