PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-205 A RESOLUTION AMENDING THE MORAVE COUNTY SUBDIVISION REGULATIONS BY SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR ELIMINATION OF THE REQUIRED PUBLIC UTILITY EASEMENTS IN NORTH RIDGE ESTATES, TRACT 3044, BEING A PORTION OF THE NE~ SECTION 28, TOWNSHIP 21 NORTH, RANGE 16 WEST, LOCATED IN THE KINGMAN AREA, MOIffiVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1992, a public hearing was conducted to determine the approval of the Petition of Exception for elimination of the required public utility easements in NORTH RIDGE ESTATES, Tract 3044, being a portion of the NE~ Section 28, Township 21 North, Range 16 West, in the Kingman area, and WHEREAS, the owner/developer of this project is Lee Bruno/Jay Schritter of Kingman, Arizona. The engineering firm responsible for plan preparation and drainage study is Mohave Engineering Associates, Inc., of Kingman, Arizona, and WHEREAS, the proposed subdivision is located one-eighth (1/8) mile north of Hualapai Mountain Road on Seneca Street and one-half (.5) mile east on Cheyenne Avenue at the south east boundary of the Kingman City Limits. Access is provided to this site from Hualapai Mountain Road via Seneca Street and Cheyenne Avenue. It is bounded by the City of Kingman on the North and '" -. . "'\ i. oJ , '-'~J . . Resolution No. 92-205 Page 2 West and the BLM on the south, and PAGE 2 OF 3 BK 2059 PG 277 (FEE~92-2950+) WHEREAS, the preliminary subdivision plan depicts 53.43 acres divided into 64 lots having a minimum lot size of 20,000 square feet and maximum of 78,000 square feet for an over all density of 1.20 lots per acre, and WHEREAS, water will be supplied by City of Kingman, electric power by Citizens Utilities Company, Telephone service by Citizens Utility Company, Fire Protection by City of Kingman, Sewage Disposal will be individual septic systems with leach fields, Solid waste will be by private carrier to Mohave County Landfill. WHEREAS, this petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of an exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: We are submitting a petition of exception request for utility easements as required by Mohave County Subdivision regulations, Article 6.9-1, as follows: 1. Elimination of the requirement for Public Utility Easements along the roadways in subdivisions. This petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: "'" AI.~ ..' , ., 1 .1 I ~ 1 j 'j . . The granting of the petition will not be detrimental to the public welfare or injurious to other adjacent properties because: A. All public utilities will be placed underground and within the roadway right-of-way which is sixty (60') feet wide. There is sufficient area outside the paved section to place all necessary utilities. Further, access to the utilities for maintenance purposes would be greatly enhanced. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other Regulations because none of the proposed exceptions will effect anything outside of the subject project. WHEREAS, the Commission, at their meeting on Wednesday, May 13, 1992 recommended APPROVAL of this Petition of Exception based on the aforementioned justifications. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1992 approved this Amendment to the Mohave County Subdivision Regulation by the granting of this petition of exception as recommended by the Planning Commission and outlined herein.
