PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORD lAG FEE 0.00 He RESOLUTION NO. 92-201 A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULA'l'ION BY SETTING FORTH THE REZONING OF A PORTION OF PARCEL 109, SECTION 19, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/4A (AGRICULTURAL RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1992, a public hearing was conducted to determine whether approval should be granted to Ralph and Valerie Sandoval of San Diego, California, for a zone change from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/4A (Agricultural Residential/Four Acre Minimum Lot Size) zone, located approximately four hundred (400') feet west of North Bank Street on Calle Charcas in the Kingman area, and WHEREAS, Section 19 is approximately six (6) miles North of the Butler area and approximately two (2) miles east of Stockton Hill Road. The subject property is located on the section line road Calle Charcas approximately four hundred (400') feet west of North Bank Street, and WHEREAS, review of the floodplain map #040058-2155B indicates this parcel to be clear of a designated floodplain. l' ........../.._, . . Resolution No. 92-201 Page 2 PAGE 2 OF 3 BK 2059 PG 266 (FEE~92-29501) The property is currently vacant. Surrounding land uses consist primarily of vacant land. The applicant desires to split this 13+ acre parcel into three 4+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The three parcels be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size). 2. Submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. :'1 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The three parcels shall meet or exceed four (4) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. The Board of Supervisors accept the granting of a thirty (30') foot roadway ingress/egress easement and eight (8') foot public utility easement along the east boundary of the subject property, beginning at the southeast corner and terminating at the southeast corner of the northern most parcel to be determined by the parcel plat. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 'j I I I I I I I i I I I 8. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being July 2, 1992, as per ARS 11-829E. 11. I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra , cartoqrapher , the Commission recommends Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions on prints. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1992 approved this Amendment to the Mohave County Zoning Regulation through the as recommended by the Mohave County Planning and and outlined herein.
