PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECOROIHG FEE 0.00 He RESOLUTION NO. 92-200 A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF A PORTION OF PARCEL 246, STOCKTON HILL RANCHES #8, BEING SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/SA (AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUN'l'Y, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1992, a public hearing was conducted to determine whether approval should be granted to Therese O. Francois of San Diego, California, for a zone change from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone, occupying the northeast corner of Deloris Avenue and Parker Street in the Kingman area, and WHEREAS, Section 36 is approximately four and one-quarter (4.25) miles North of the Butler area and approximately one- quarter (.25) mile east of Stockton Hill Road. The subject property is located on Deloris Avenue, a quarter section line road approximately one-half (.5) mile west of Cherum Road, and WHEREAS, review of the floodplain map #040058-2155B indicates this parcel to be clear of a designated floodplain. - " L I j I 1 j i J t i 'I 1 I '1 'I 1 . . The applicant desires to split this 13+ acre parcel into three 4+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning, Commission on May 13, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The two parcels be zoned A-R/5A Residential/Five Acre Minimum Lot amendment was at the request of the accordance with the area plan. (Agricultural- Size) . This applicant and in 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3 . The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two parcels shall meet or exceed five (5) acres exclusive of road easements or rights-of-way. 6 . The Parcel Plat shall show any surface drainage or FEMA flood zones. 7 . That the Board of Supervisors accept the abandonment of the existing fifty (50') foot roadway easements along the western and southern boundaries of the subject property, to be replaced by the dedication of a thirty- five (35') foot right-of-way along the western boundary and a thirty (30') foot right-of-way along the southern boundary. In addition, a twenty (20') foot radius at the southwestern corner of the above described property. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. .. -". ~.~ . . That a special twenty-five (25') foot building setback be established on the southern boundary of the above described property. 9. That the existing public utility easement shall remain. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being July 2, 1992, as per ARS 11-829E. 13. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Commission recommends Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions on prints. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. ) ..... Resolution No. 92-200 Page 4 PAGE 4 OF 4 BK 2059 PG 264 (FEE~92-29500) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1992 approved this Amendment to the Mohave County Zoning Regulation through the change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
