PAGE 1 OF + MOHAVE COUHTY BOARD Of SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-195 A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF A PORTION OF THE W~ W~ SECTION 8, TOWNSHIP 20 NORTH, RANGE 17 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: M/2A (GENERAL MANUFACTURING/TWO ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 1, 1992, a public hearing was conducted to determine whether approval should be granted to Ron S. and Carol Gifford of Las Vegas, Nevada, for a zone change from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to M/2A (General Manufacturing/Two Acre Minimum Lot Size) zone, located between Highway 66 right-of-way and the AT&SF R.R. rail line and south of McConnico interchange in the Mohave County General area, and WHEREAS, Section 8 is located approximately five (5) miles southwest of Kingman and is bisected by Interstate 40 (1-40). The subject property is accessed from 1-40 via the McConnico interchange east to the frontage road thence south approximately one-quarter (.25) mile on the east side of the road, and ,/] . j WHEREAS, review of floodplain map #040058-2325B indicates this area to be clear of a designated floodplain. The property is a triangular shaped piece formed by the 1-40 right-of-way to the west and the railroad right-of-way is the east. The railroad also owns the property to the north. The applicant desires to establish a salvage, scrap & dismantling yard. The McConnico area contains a number of heavy commercial uses: The MNX trucking company, a number of other trucking related businesses and another salvage yard. This area is within the Urban-Overlay zone and Building Code enforcement area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 13, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the understanding accepting the following applicant and conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant comply with all applicable provisions of Section 23 of the Mohave County Zoning Regulations. NOTE: THE FOLLOWING REQUIREMENTS. 3 ENVIRONMENTAL ITEMS APPLY TO 3. Arizona Department of Environmental Quality approves the water distribution system. 4 . Arizona Department of Water Resources approves the quantity and quality of the water supply. 5. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. lo'.ot . . . . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 7. A one (1') foot vehicle non-access easement shall be established along the west boundary of this parcel contiguous to Interstate 40's eastern right-of-way except for approved access points. A eight (8') foot block wall shall be required along this easement. (Commission would consider an engineered design to assure lot protection and non-access in lieu of a block wall. ) 8. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or better. 9. The owner/developer shall pave the 1-40 frontage road from the edge of pavement up to the ingress/egress to this property. The paving of the aforementioned roads shall be in accordance with Mohave County Standards 101.10A or better and shall be placed on the center line of roadway right-of-ways in a width and design as approved by the County Engineer and coordination with ADOT for access to Interstate 40. 10. The applicant obtain required ADOT permits for access to Interstate 40 if applicable. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. 11. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Resolution No. 92-195 Page 4 14. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. No open lot storage materials shall be stacked higher than the fence. Fencing shall display no advertising. 15. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being July 2, 1992, as per ARS 11-829E. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. PAGE 4 OF 4 BK 2059 PG 240 (FEEt92-29495) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 1, 1992 approved this Amendment to the Mohave County zoning Regulation through the ,I recommended by the Mohave County Planning and herein.
