RESOLUTION NO. 92-193
A RESOLUTION AMENDING THE MORAVE COUNTY ZONING REGULATION BY
SETTING FORTH THE REZONING OF PARCEL 293 ROADWAY EASEMENT MAP,
BEING THE SE~ SW~ SECTION 14, TOWNSHIP 21 NORTH, RANGE 19 WEST,
TO BE KNOWN AND SUBDIVIDED AS VALLEY PARK ESTATES, TRACT 3041,
FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT
SIZE) ZONE, PROPOSED TO BE: R-1/13M (SINGLE FAMILY
RESIDENTIAL/THIRTEEN THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE,
LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 1, 1992, a public hearing was
conducted to determine whether approval should be granted to Al
Haley, DELBAR ENTERPRISES of Kingman, Arizona, for a zone change
from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum
Lot Size) zone to R-l/13M (Single Family Residential/Thirteen
Thousand Square Foot Minimum Lot Size) zone, occupying the
northwest corner of Concho Road and Redwall Drive in the Golden
Valley area, and
WHEREAS, the subject property is located approximately nine
and one-half (9.5) miles west of the junction of Highway 93 & 68
and is approximately two (2) miles south of Highway 68.
This
property is accessed from Highway 68 via Estrella Road south
approximately one and three-quarters (1.75) miles to Redwall
Drive thence east approximately one-quarter (.25) mile to the
northeast corner of Redwall Drive and Carrizo Road, and

WHEREAS, review of floodplain map #040058-2325B indicates a
portion of this parcel to be within a designated floodplain. The
parcel is currently vacant land and zoned A-R/I0A (Agricultural-
Residential/Ten Acre Minimum Lot Size). This project is bordered
on the north, east and west by undeveloped land and on the south
by Golden Sage Ranchos, Unit #85, and

WHEREAS, the developer has processed an area plan amendment
for the forty (40) acre parcel.
Redwall Drive will be paved to
Estrella Road and shall serve as the major arterial feeding into

this project. Estrella Road is proposed to be developed via the

Golden Valley Improvement District #1. Projected date for paving
is July, 1992, and
WHEREAS, the size of this development is approximately forty
(40) acres. The developer oriqinally proposed 184 lots having a
minimum lot size of 6,000 square feet and a maximum of 9,450
square feet, and

WHEREAS, this item was continued from the November &

December, 1991 Planning & Zoning Commission meetings at the
request of the applicant in order to meet with the surrounding
property owners who expressed concerns about this project. The
meeting was scheduled for December 18, 1991 at 2:00 P.M. at the
Planning Department offices.
Present at the meeting were six
property owners, staff from Planning & Zoning and Public Works

and County Assessor, the applicant & his representative and a
representative from the company who was slated to install the
wastewater treatment plant.
The meeting was held to answer
questions put forth by the property owners at the November
Planning a& Zoning Commission meeting. The questions and issues
discussed were drainage, road improvements, property values,
wastewater treatment plant and density impacts. After completion
of the meeting some of the property owners were still in
opposition based on the density of the project but the other
concerns were, in staff's opinion, adequately addressed. The
applicant contacted other property owners to ascertain if their
concerns could be mitigated, and
WHEREAS, the item came back to the Commission for action at
the January 8, 1992 meeting.
The applicant indicated to Staff
that he wished to pursue a redesign of this tract.
Staff
recommended this item be CONTINUED until such time as the new
design is approved and a modified zoning request is submitted.
The Commission approved the recommendation, and
WHEREAS, the applicant has pursued a redesign of the tract
and is now seeking approval of a modified zoning application.
The new proposal is as follows: 91 lots having a minimum lot size
of 13,000 square feet and a maximum of 18,900 square feet. There
are proposed within the new design three parcels containing
respectively a neighborhood park, playground and parking and an

office building for the property owners association.
The sewage
treatment plant concept has been removed and replaced by
individual septic systems, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 13, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:
1. Compliance with the Revised Preliminary Plat approval
conditions stated in Resolution 92-148.

The applicant comply with all applicable provisions of
Sections 25, 26, 27, and '31 of the Mohave County Zoning
Regulations. In addition to compliance with Ordinance
87-1 (Dark Sky Ordinance).
3. Parcels A & B & D be approved for a N-P (Neighborhood
Park) zone in accordance with Section 15.3 of the
Mohave County Zoning Regulations. Only parcel g shall
have permitted uses items ~ ~ 1. Maintenance of these
facilities shall be the responsibility of the
homeowners association until such time as the Board of
Supervisors accepts them into the County system.
4. Parcels A, B & D be used only for purposes stated on
the final plat.
5. Any remainder of the lots not used for development
shall be maintained free of debris and the vegetation
controlled to m~n~m~ze potential fire hazards.
Grasses /weeds shall be cut regularly to assure less
than eight (8") inches of growth. If crushed rock is
used then the soil shall be maintained in a weed free
condition.
6. Pertinent zoning/Building/environmental health permits
be obtained.
7. The rezone shall become effective upon the recordation
of the Final Plat. IT development is phased, then only
the zoninq for that phase shall become effective.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on May 17, 1992, and posted May 15, 1992
as required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 1, 1992 approved this
Amendment to the Mohave County Zoning Regulation through the
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
