RESOLUTION NO. 92-266 A RESOLUTION SETTING FORTH THE REZONING OF THE SE~ SECTION 14, TOWNSHIP 22 NORTH, RANGE 17 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-2 (GENERAL COMMERCIAL) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 3, 1992, a public hearing was conducted to determine whether approval should be granted to William E. and Joan E. Sayles of Borrego Springs, California, represented by Jon G. Longoria of Las Vegas, Nevada, for a zone change from the existing A-R/10 (Agricultural Residential/Ten Acre Minimum Lot Size) zone to C-2 (General Commercial) zone, occupying the intersection of Stockton Hill Road and Bull Mountain Road in the Kingman area, and WHEREAS, Section 14 is located approximately two and one- half (2.5) miles north of the Northern Avenue and Stockton Hill road intersection. The site occupies the intersection of Stockton Hill Road and Bull Mountain Road and extends north for approximately one thousand feet, and WHEREAS, review of floodplain map #040058-2165C indicates this area to be clear of a designated floodplain, however the ......; . . . . . It appears from field inspection and extrapolation of information from the above referenced that there be drainage FEMA map may considerations that will need to be addressed on this site, and WHEREAS, the approximately nineteen (19) acre site is currently vacant. Surrounding land uses consist of vacant land. The applicant desires to establish a real estate sales office on an approximately five (5) acre site at the intersection of Stockton Hill Road and Bull Mountain Road. The remainder will retain its A-R/10A zoning. The location to be zoned commercial is located within the Long Mountain Area Plan boundaries and is designated for potential commercial uses, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The commercial site be zoned C-2/4A (General Commercial/Four Acre Minimum Lot Size). The remainder of the parcel will keep the existing A-R/10A zoning. 3. Resolution No. 92-266 Page 3 NOTE: NOTE: 4. The remaining residential site shall meet or exceed ten (10) acres exclusive of road easements or rights-of- way. THE FOLLOWING ITEM APPLY TO ENVIRONMENTAL REQUIREMENTS: 5. Applicant submit proof of hookup to an approved sewage treatment facility and water system. THE FOLLOWING ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS: 6. A one (1') foot vehicle non-access easement and physical barrier a minimum of three (3') feet in height will need to be provided for the commercial development at the intersection of Stockton Hill Road and Bull Mountain Road extending back one hundred (100') feet from said intersection. (Commission would consider an engineered design to assure lot protection and non- access in lieu of a block wall.) 7. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 8. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or better. NOTE: THE FOLLOWING ITEMS APPLY TO PARCEL PLAT REQUIREMENTS: 9. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 10. The commercial parcel shall meet or exceed four (4) acres and the residential parcel shall meet or exceed ten (10) acres exclusive of road easements or rights- of-way. 11. The establishment of a minimum lot size based on the size of the parcel per the recorded Parcel Plat. 12. The Parcel Plat shall show any surface drainage or FEMA flood zones. 13. The Board of Supervisors accept the DEDICATION of a fifty (50') foot road right-of-way along the west boundary being Stockton Hill Road, forty-two (42') foot road right-of-way along the east boundary being Bull Mountain Road and thirty (30') foot radii: at the intersection of these right-of-ways. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statements and dedication/granting be shown on the Parcel Plat. 14. No building/zoning/environmental permits issued until after Parcel Plat recordation. shaJ,l be NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS: 15. A buffer, in the form of a six (6') foot block wall shall be required along the entire boundary where commercial & residential uses and zoning abut. The construction of this buffer may be delayed until the property to the north is residentially occupied/developed. (Commission would consider an engineered design to assure lot protection and non- access in lieu of a block wall.) 16. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. 17. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being September 2, 1992, as per ARS 11-829E. 19 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ., PAGE 4 OF 5 BK 2089 PG 240 (FEE~92-42715) '"1 ":':-1:~' " .. ^, . . Resolution No. 92-266 Page 5 At the request of Roqer Esquerra , cartoqrapher, the Planninq Commission recommends Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions on prints. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 18, 1992, and posted July 15, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 3, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
