PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDInG FEE 0.00 Nt RESOLUTION NO. 92-265 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A SINGLE FAMILY RESIDENCE, IN A C-2 (GENERAL COMMERCIAL) ZONE ON LOT 6, BLOCK 117, NEW KINGMAN ADDITION #8, TRACT 1101, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held August 3, 1992 a public hearing was conducted to determine whether approval should be granted to August W. Scrivner of Kingman, Arizona, for a Zoning Use Permit (ZUP) for the establishment of a single family residence in a C-2 (General Commercial) zone on Lot 6, Block 117, New Kingman Addition #8, Tract 1101, located in the Kingman area, and WHEREAS, Block 117 is located approximately two and one-half (2.5) miles north of the Interstate 40 (1-40) and Andy Devine Avenue (Highway 66) interchange. The subject property is accessed from Highway 66 via North Castle Rock Road, approximately two (2) miles north of the interchange, north approximately one and one-quarter (1.25) miles to Northern Avenue, thence west approximately one (I) mile to North Bank Street, thence north four hundred eighty (480') feet to Neal Avenue, thence west one hundred seventy-five (175') feet to Lot 6, and -, . . Resolution No. 92-265 Page 2 WHEREAS, review of floodplain map #040058-2165C indicates this area to be clear of a designated floodplain. The site is currently vacant. Surrounding land uses consists of residences in a C-2 zone to the south, vacant land to the west and north, a duplex to the east and a commercial business to the southeast. The applicant desires to establish a single family residence in this commercial zone, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on July 8, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87 -I (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits and Floodplain Use Permits be obtained. 3. The residential use shall comply with all provisions of an R-1 zone. 4. If a mobile home is utilized for the residence the mobile home shall have an affixed HUD label. 5 . The home shall be used as a residence not be used in conjunction with the General COffiTIlercial zoning. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 8. If these conditions are not met within one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 18, 1992, and posted July 15, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 3, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
