PAGE 1 OF 4 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 92-264 A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 21, LAZY Y-U RANCH, PRASE I, SECTION 11, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/9A, 13A, AND 17A (AGRICULTURAJJ RESIDENTIAL/ NINE, THIRTEEN & SEVENTEEN ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 3, 1992, a public hearing was conducted to determine whether approval should be granted to Sam and Linda Yarbrough of Kingman, Arizona, for a zone change from the existing A-R/36A (Agricultural Residential/Thirty-Six Acre Minimum Lot Size) zone to A-R/9A, 13A & 17A (Agricultural Residential/Nine, Thirteen & Seventeen Acre Minimum Lot Size) zone, located in the northwest foothills of the Hualapai Mountains in the Kingman area, and WHEREAS, the subject property is located approximately four (4) miles southeast of the Kingman City Limits, on Hualapai Mountain Road. The subject property is approximately one (1) mile southeast of Hualapai Mountain Road and is accessed via Lazy Y-U Drive, Pack Saddle Drive and Bridle & Bit Trail, and WHEREAS, review of floodplain map #2350-3450 indicates this area to be within Flood Zone C (area of minimal flooding). The ., " . . Resolution No. 92-264 Page 2 terrain is rugged mountain foothill country. Well constructed gravel base roads serve these properties. The site is currently vacant and bordered on all sides by vacant land. The property is currently zoned A-R/36A. The owner is requesting a division into three (3) parcels. The zone change is for A-R/9A, A-R/13A and A- R/17A Parcel designations from this original forty (40) acre parcel, and WHEREAS, Lazy Y-U Ranch, Phase I, is the division of three (3) sections, plus eighty (80) acres, into fifty (50) parcels of forty (40) or more acres each. The developers plan to divide an additional six (6) sections of land in the future, and . .: '.'-~" j .] . ~. ;,"" WHEREAS, all roads are easements and as such do not create parcel divisions, according to the state Real Estate office. The road designation is designated as follows: "easements shown...are perpetual in nature and are created for ingress/egress, drainage and public utility purposes for the benefit of each of the parcels and their owners and the public". The project attorneys recommended this wording to accommodate the public, and WHEREAS, there is no specific Area Plan for this area, and it is not within the Building Overlay area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1992, the Commission " PAGE 2 OF 4, BK 2089 PG 231 (FEE~92-~2713) ~ . . Resolution No. 92-264 Page 3 recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. Any new ingress/egress easements shall also be Public Utility Easements. 5. The Parcel Plat shall show any surface drainage and the FEMA flood zones. 6. No building/zoning permits shall be issued until after Parcel Plat recordation. 7. That appropriate zoning, building, environmental, and floodplain permits be obtained. 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being September 2, 1992, as per ARS 11-829E. 9. I f these conditions are not met wi thin one (I) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board, after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planning Commission recommends Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions on prints. Resolution No. 92-264 Page 4 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 18, 1992, and posted July 15, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 3, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
