A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF SECTION
7, TOWNSHIP 20 NORTH, RANGE 17 WEST, TO BE KNOWN AND SUBDIVIDED
AS WAJJNUT CREEK II, TRACT 3043, FROM: A-R/10A (AGRICULTURAL
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-
R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE,
LOCATED IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on August 3, 1992, a public hearing was
conducted to determine whether approval should be granted to
WALNUT CREEK DEVELOPMENT, represented by Dennis Sim, Kingman,
Arizona,
for
change
from the existing A-R/10A
a
zone
(Agricultural ReSidential/Ten Acre Minimum Lot Size) zone to A-
R/IA (Agricultural Residential/One Acre Minimum Lot Size) zone,
located west of Oatman Road, south of the McConnico Interchange,
in the Mohave County General area, and
WHEREAS, Section 7 is located east of the Interstate 40 (1-
40)/McConnico interchange south of Kingman.
The project is
accessed
from
Interstate
40,
exiting
the
McConnico
at
Interchange, west to Oatman Road, thence southwest to McConnico
Road, thence west through Walnut Creek Estates Unit No.2, Tract
3013, and

WHEREAS, review of floodplain map #040058-2325B indicates
this area to be clear of a designated floodplain.
The site is
currently vacant.
Surrounding land uses consist of vacant BLM
land to the north and west, vacant land to the south and walnut
Creek Estates Unit No.2, Tract 3013, to the east, and
WHEREAS, the owner/developer is proposing to develop one
hundred sixty (160) lots for residential use wi thin this two
hundred eleven (211) acre tract. Minimum lot size is proposed to
be one (1) acre.
The project is to be developed in four (4)
phases, and

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on July 8, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:
1. Compliance with the conditions stated on the
Preliminary Plat approval in Resolution No. 92-236.
2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Ordinance 87-1 (Dark Sky
Ordinance) is also required.
3. The establishment of a minimum lot size based on the
size of lots per the recorded Final Plat.
4. All residential lots shall meet or exceed one (1) acre
exclusive of road easements or rights-of-way.

6. The rezone shall become effective upon the recordation
of the Final Plat. li development is phased, then only
the zoninq for that phase shall become effective.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat boundaries be a triple wide line
as the 1/8" blue line border obscures dimensions on prints.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on July 18, 1992, and posted July 15, 1992 as
required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, August 3, 1992 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
