PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-261 A RESOLUTION SETTING FORTH THE REZONING OF N~ NW~ AND N~ NE~ PARCEL 328 EXCEPT THE NORTH 233 FEET OF THE EAST 233 FEET OF THE N~ NE~ SECTION 28, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A- R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 3, 1992, a public hearing was conducted to determine whether approval should be granted to JoRita Serrano, Michael A. Pacheco and Shelley Pacheco of Phoenix, Arizona, for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A- R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone, occupying the southeast corner of verde Road and Bolsa Drive, in the Golden Valley area, and WHEREAS, Section 28 is approximately two and one-half (2.5) miles south of Highway 68 and approximately four (4) miles west of the Highway 68 and 93 junction. The subject property is accessed from Highway 68 via Verde Road south approximately two and one-half (2.5) miles the southeast corner of verde Road and Bolsa Drive, and '. . . Resolution No. 92-261 Page 2 WHEREAS, review of the floodplain map #040058-2325B indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of single family dwellings and vacant land. The applicant desires to split this 8+ acre parcel into three 2+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 8, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The three parcels be zoned A-R/2A (Agricultural- Residential/Two Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The three parcels shall meet or exceed two (2) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. The Board of Supervisors accept the abandonment of the existing fifty foot (50') roadway easement located at the south east boundary of the above described property to be replaced by the dedication of a thirty foot (30') road right-of-way along the southeast boundary, and a fifty foot (50') road right-of-way along the northern and western boundaries. In addition the granting of a twenty (20') foot public utility easement along the southeast boundary and an eight foot (8') public utility easement on the northern and western boundaries of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. 8. No building/zoning permits shall be issued until after Parcel Plat recordation. 9. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being September 2, 1992, as per ARS 11-B29E. '~~'., ':- 11 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Parcel Plat boundaries be a tri le wide line as the 1 8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 18, 1992, and posted July 15, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. Resolution No. 92-261 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 3, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
