A RESOLUTION SETTING FORTH THE REZONING OF THE NW~ SW~ SECTION
23, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED
AS COURTNEY PARK EAST, TRACT 4147, FROM: A-R (AGRICULTURAL
RESIDENTIAJJ) ZONE, PROPOSED TO BE: R-M/6M (MULTIPLE FAMILY
RESIDENTIAL/SIX THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE,
LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on August 3, 1992, a public hearing was
conducted to determine whether approval should be granted to
Dennis Gootrad of Westlake Village, California, for a zone change
from the existing A-R (Agricultural Residential) zone to R-M/GM
(Multiple Family Residential/Six Thousand Square Foot Minimum Lot
Size) zone, located in the South Mohave Valley area, and
WHEREAS, Section 23 is located two (2) miles south of
Bullhead City's southernmost border.
The proposed project is
accessed from Highway 95 via Aztec Road one-quarter (.25) mile
east at the southeast corner of the intersection of the proposed
Mesa Villas Drive and Aztec Drive, and
WHEREAS, review of floodplain map #040058-2445C indicates
this area to be located within a designated floodplain. The site
is currently vacant.

Greens, Tract 4054-A to the east, proposed Mesa Villas, Tract
4146 to the west, proposed Courtney Place Townhomes, Tract 4071
to the south and proposed Aztec village, Tract 4144 to the north.
Courtney Greens is proposed single family while the remainder are
proposed multifamily densities, and
WHEREAS, the preliminary subdivision plan depicts seven plus
(7.12) acres divided into thirty-four (34) lots (4 units/lot)
having a minimum lot size of 6,000 square feet and a maximum of
12,025 for an overall lot density of nineteen (19) units/acre.
Historically the Planning Commission has required open space and
amenities when a subdivision has this high of a density. The
preliminary plan was modified to allow for two (2) lots to be set
aside as open space. The two (2) lots at the end of the cul-de-
sac will be designated as open space parcels and will have a
playground and picnic benches, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on July 8, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant understanding
and
accepting
the
following
conditions:
1. Compliance with the conditions stated on the
Preliminary Plat approval in Resolution No. 92-232.
2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Ordinance 87-1 (Dark Sky
Ordinance) is also required.

3. The establishment of a minimum lot size based on the
size of lots per the recorded Final Plat.
4. All residential lots shall meet or exceed six thousand
(6,000) square feet exclusive of road easements or
rights-of-way.

6. Compliance with Section 27.P (Site Plan Requirements)
will be required for each individual site as they are
developed/occupied by apartments.
7. The county has previously amended and approved up to 16
dwelling units (d.u.) per acre for R-M (Multiple-
Residential) projects with amenities. Staff recommends
the applicants request for higher density should be
approved only if the applicant can match the high
standards set forth by the previous, precedent setting
cases such as:

ramada with picnic tables, proper fencing and
limited access
The lack of amenity provisions should revert the
requested d.u. density to the 8 d.u. per acre density
as set by ordinance.
8. Submittal of a site plan for the open space areas and
above mentioned amenities be submitted before
recordation of this tract. If phased the open space
area and amenities shall be constructed with the first
phase.
9. The rezone shall become effective upon the recordation
of the Final Plat. Ii development is phased, then only
the zoninq for that phase shall become effective.

County, Arizona, on July 18, 1992, and in the Mohave Valley Daily
News, and posted July 17, 1992 as required by Arizona Revised
Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, August 3, 1992 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
