A RESOI,UTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY
SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE
ESTABLISHMENT OF A SINGLE FAMILY RESIDENCE, IN A C-2 (GENERAL
COMMERCIAL) ZONE ON LOT 3, BLOCK 137, NEW KINGMAN ADDITION 19,
TRACT 1102, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held July 6, 1992 a public hearing was conducted
to determine whether approval should be granted to Joe and Joan
Bettinger of Santa Ana, California, for a Zoning Use Permit (ZUP)
for the establishment of a single family residence in a C-2
(General Commercial) zone on Lot 3, Block 137, New Kingman
Addition #9, Tract 1102, located in the Kingman area, and

WHEREAS, Block 137 is located approximately two and one-half
(2.5) miles north of the Interstate 40 (1-40) and Andy Devine
Avenue (Highway 66) interchange.
The subject property is
accessed
from Highway
66
via North Castle
Rock Road,
approximately two (2) miles north of the interchange, north
approximately one and one-quarter (1.25) miles to Northern Avenue
thence west approximately three-quarters (.75) mile to North
Melody Street thence north four hundred eighty (480') feet to
Neal Avenue thence east six hundred twenty (620') feet to Lot 3,

WHEREAS, review of floodplain map #040058-2165C indicates
this area to be within 3. desiqnated floodplain.
The site is
currently vacant.
Surrounding land uses consists of vacant lots
to the west, north and southwest and commercial businesses to the
south and east.
The applicant desires to establish a single
family residence in this commercial zone. There was some concern
expressed by the Commission and staff regarding the proximity of
these lots to commercial uses-
If this request is approved
provisions should be made to place a buffer wall between this lot
and surrounding commercial and multiple family uses, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on June 10, 1992 and did generate a
recommendation of APPROVAL of the requested zoning Use Permit

contingent upon the following conditions:
1. The applicant comply with all applicable prdvisions of
Sections 25, 26, 27, and 31 of the Mohave County zoning
Regulations. Compliance with Section 27. P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
2. That appropriate zoning/building/environmental permits
and Floodplain Use Permits be obtained.
3. The residential use shall comply with all provisions of
an R-1 zone.
4. A buffer, in the form of a solid fence, six (6') feet
in height shall be required along the east and south
boundary. Location of the fence shall be coordinated
with the local utilities.
5. If a mobile home is utilized for the residence the
mobile home shall have an affixed HUD label.

year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
8. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.

I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
acco~dance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on June 21 1992, and posted June 19, 1992
as required by the Arizona Revised Statutes and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, July 6, 1992 approved this
Amendment to the Mohave County Zoning Regulation by granting this
