PAGE 1 OF -4 .~J~~~- HOHAVE COUNTY BOARD OF SUPERVISORS ~ RECORDIHG FEE 0.00 He RESOLUTION NO. 92-241 A RESOLUTION AMENDING THE MOHAVE COUNT.J~d:ING REGULATION BY SETTING FORTH THE REZONING OF THE NE~~ SECTION 33, TOWNSHIP 19 NORTH, RANGE 18 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/8A (AGRICULTURAL RESIDENTIAL/EIGHT ACRE MINIMUM LOT SIZE) AND A- R/17A (AGRICULTURAL RESIDENTIAL/SEVENTEEN ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 6, 1992, a public hearing was conducted to determine whether approval should be granted to William Goldberg and David Ford of Ventura, California, for a zone change from existing A-R/36A (Agricultural the Residential/Thirty-Six Acre Minimum Lot Size) zone to A-R/8A and "I . I 17A (Agricultural Residential/Eight and Seventeen Acre Minimum Lot Size) zone, located on the south side of Secret PaSs Drive, fourteen hundred (1,4 00 ~) feet west of Sacramento Road in the Golden Valley area, and WHEREAS, Section 33 is approximately six (6) miles south of Old Oatman Road and approximately seven (7) miles from the Old Oatman Road and Interstate 40 junction. The subject property is accessed from Old Oatman Road via Sacramento Road south approximately six (6) miles to Secret Pass Drive thence west approximately one-half (.5) mile to the northeast corner of the " - .., . . Although Secret Pass Drive does not actually phys ically exist, the property owner does intend to grade the existing forty (40') foot right-of-way to the subject property, and WHEREAS, review of the floodplain map #040058-2500B indicates this parcel to be located within FEMA desiqnated Special Flood Hazard Area. This area requires Floodplain Use Permit for any development. The property is currently vacant. Surrounding land uses consist primarily of vacant land. 'l'he applicant desires to split this forty (40+) acre parcel into two 8+ acre parcels and one 17+ acre parcel, and WHEREAS, at the public hearing before the Mohave County -'I . I Planning and Zoning Commission on June 10, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicants understanding and accepting the following conditions: 1. The western parcel be zoned A-R/17A (Agricultural- Residential/Seventeen Acre Minimum Lot Size) and the eastern parcels be zoned A-R/8A (Agricultural- Residential/Eight Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. " PAGE 2 OF ~ BK 2077 PG 31 (FEE~92-37272) . . The western parcel shall meet or exceed seventeen (17) acres and the eastern parcels shall meet or exceed eight (8) acres exclusive of road easements or rights- of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7 . The Board of Supervisors accept the dedication of a forty-two (42') foot road right-of-way along the northern boundary of this parcel, a thirty-five (35') foot road right-of-way along eastern boundary, a thirty (30') foot road right-of-way along the southern boundary and a thirty foot (30') road right-of-way along the western boundary. Also the dedication of twenty (20') foot radius curves at the northeast, northwest, southeast and southwest corners of the subject property. In addition the granting of an eight ( 8') foot public utility easement along the east and northern boundaries of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. 8. No building/zoning permits shall be issued until after Parcel Plat recordation. "( . I . 9. That appropriate zoning/building/environmental permits and Floodplain Use Permits be obtained~ 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being August 5, 1992, as per ARS 11-829E. . j i 11 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. Resolution No. 92-241 Page 4 At the request of Roqer Esquerra, cartoqrapher , the Planninq Commission recommends Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on June 21, 1992, and posted June 19, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 6, 1992 approved this Amendment to the Mohave County Zoning Regulation through the change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
