PAGE 1 OF 6 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-236 A RESOLUTION AMENDING THE MORAVE COUNTY SUBDIVISION REGULATIONS BY SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN WITH A PETITION OF EXCEPTION FOR WALNUT CREEK III, TRACT 3043, BEING A SUBDIVISION OF A PORTION OF SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY , ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 6, 1992, a public hearing was conducted determine approval of preliminary the to the subdivision plan and petition of exception for WALNUT CREEK III, Tract 3043, and WHEREAS, ';t ,the owner/developer is Walnut Creek Development Company, Mr. Dennis Sim, Kingman, AZ. The engineer responsible for plan preparation and the drainage study is Jack Stovall of Stovall Engineering, in Bullhead City, Arizona, and WHEREAS, the owner/developer is proposing to develop one hundred sixty (160) lots for residential use within this two hundred eleven (211) acre tract. Minimum lot size is proposed to be (1) one acre. Average density is 1.32 acres per lot. The project is to be developed in (4) four phases. Roadways and ~ ~ Drainage Parcel A through F will be dedicated by the Final Plat to Mohave County, and " <: .... . . Resolution No. 92-236 Page 2 WHEREAS, this property is located off of Interstate 40, exiting at the McConnico Interchange, west to Oatman Road, turn right at McConnico Road, through walnut Creek Estates Unit No.2, Tract 3013. The property to the north and west is BLM land. Property to the south is in Trust No. 5757, First American Title Ins. Company, and WHEREAS, water service will be provided by Walnut Creek Water Company, Inc. Electric service will be provided by Citizens Utilities Company, Inc. Telephone service wi II be provided by Citizens Utilities Rural Company, Inc. Sewage disposal will be by individual septic systems. Golden Valley Fire Department has stated they will respond in emergencies, however, this subdivision is not within their district, and ~.t WHEREAS, Petitions of Exception were submitted for the following: A. Single tiered lots - The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because access is limited. This request will not nullify the intent or purpose of the Master plan of the County or other regulations because of the planned intent to enhance the traffic circulation and drainage design. The special circumstance or condition affecting said property is the location of drainage parcels adjacent to the single tiered lots to carry offsite flows through the proposed subdivision. Blocks exceeding 1320 feet in length The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because the block is designed in conjunction with the drainage plan to direct the flow of storm water. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because the drainage plan meets County Standards and is an acceptable and approved method of controlling and directing runoff. The special circumstances or conditions affecting said property are a better design to direct runoff and additional access would not be desirable. C. Non-radial lot lines The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because the non-radial lot lines allow for a more natural drainage pattern. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because the overall drainage is planned for the purpose of the health, welfare and safety in an area of planned growth and development. The special circumstances or conditions affecting said property are the topography and natural drainage pattern is better / I utilized and design allows for usable building areas on each lot. D. Variance to Standard Specifications - The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because adequate streets have been designed and constructed. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because: 1) Overall plans for this subdivision were approved prior to the extension of the Mohave County Urban Overlay Zone; 2) The roads have already been constructed as per Mohave County Subdivision and Road Maintenance Regulations, Section 4.3-2, which states, "Minimum roadway improvements in subdivisions containing lots one (1) acre or larger shall be unpaved roadways as specified in these regulations, Mohave County Department of Engineering Standard Specification Numbers 101.10C and 161, and Standard Detail Number 60 series"; and 3) The roads were constructed in good faith, " PAGE 3 OF 6 BK 20n PG 1~ (FEE"2-37267) . . Resolution No. 92-236 Page 4 based upon agreements with the former Planning Director. The special circumstances or condition affecting said property are as follows: a) This is a rural area, with minimum one (1) acre lots; and b) Based upon the aforementioned agreements with the former Planning Director, the roads have already been constructed. WHEREAS, the Planning Commission, at their regular meeting on June 10, 1992, did recommend APPROVAL of the Petition of Exception based on the aforementioned justifications, and WHEREAS, the Commission, at their meeting on June 10, 1992, did recommend CONDITIONAL APPROVAL of the preliminary subdivision plan for Tract 3043, with the following noted: 1. The CONDITIONAL approval of this subdivision is based on the understanding of the Planning and Zoning Commission that all streets within the subdivision will be ~ constructed in accordance with Standard Spe~lfications #161 and 101.10C or better; a water supply and distribution system (including fire flow or an alternative storage system for designated areas as determined by the State Fire Marshal) will be constructed to serve each lot; grading and drainage related improvements will be completed as recommended by the design engineer and as approved by the County Engineer in the submitted drainage report; arrangements will be made to extend electric and telephone service to each lot in accordance with Arizona Corporation Commission regulations; approval for water system and sewage disposal shall be obtained from the Arizona Department of Environmental Quality. Water availability statement shall be obtained from the Arizona Department of Water Resources; all lots and street centerline monuments will be staked and monumented in accordance with Standard Specification #102; street name and regulatory signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as recommended by the design engineer; and the " PAGE + OF it BK 2077 PG 13 (FEE~92-37267) , . . . Resolution No. 92-236 Page 5 owner subdivider is responsible for the completion of improvements and shall provide assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations. 2. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as required for approval of this tract by the Board and a final copy of the State Real Estate Report shall be submitted to P&Z staff. This copy shall be for library purposes. 3. CC&R's recorded in Docket Book 1429 at pages 295 - 305 shall be amended to include this subdivision. 4. The County Engineer has made comments in regard to Page A-29 of the revised drainage report. This report indicates flow velocities within the ditch section at 7.54 feet per second. The County Engineer recommends flows within an unlined channel not exceed 4-5 fps to minimize erosion. This item needs to be addressed to the satisfaction of the County Engineer prior to Final Plat action on this subdivision. .~~_.J 5. The acquisition of the forty-two (42') feet matching right-of-way along the West boundary of this development from BLM will need to be obtained by the dev~loper and the easement granted to Mohave County J prior to Final Plat recording. The developer shall bear the expense of clearing all of the environmental concerns of the BLM. 6. This property to be rezoned to A-R/1A acre. 7 . Actions should be taken to annex this area into an existing fire district. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Final Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions.
