RESOLUTION NO. 92-234 A RESOLUTION AMENDING THE MOHAVE COUNTY ZONING REGULATION BY SETTING FORTH THE REZONING OF THE E~ N~ NE~ NW~ SECTION 25, TOWNSHIP 26 NORTH, RANGE 19 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) AND A- R/3A (AGRICULTURAL RESIDENTIAL/THREE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE DOLAN SPRINGS AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on JULY 6, 1992, a public hearing was conducted to determine whether approval should be granted to James L. and Ethel E. Dunn of Dolan Springs, Arizona, for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/2A & 3A (Agricultural "( Residential/Two and Three Acre Minimum Lot Size) zone, occupying the southwest corner of Kitmit Drive and 15th Street in the Dolan Springs area, and WHEREAS, Section 25 is approximately eight (8). miles northeast of Highway 93 and the Pierce Ferry Road junction. The subject property is accessed from Pierce Ferry Road via 15th Street west approximately one-half (.5) mile to the northeast corner of the subject property, and " "- . . Resolution No. 92-234 Page 2 WHEREAS, review of the floodplain map #040058-1800B indicates this parcel to be clear of a designated floodplain. The property is currently occupied by a single family residence. Surrounding land uses consist primarily of single family homes and vacant land. The applicant desires to split this 10+ acre parcel into two 2+ acre parcels and one 4+ acre parcel, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 10, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following -, conditions: 1. The northern and western parcels be zoned A-R/2A (Agricul tural Residential/Two Acre Minimum Lot Size) and the southeastern parcel be zoned A-R/3A (Ag~~cultural-Residential/Three Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The northern and western parcels shall meet or exceed two (2) acres and the southeastern parcel shall meet or exceed three (3) acres exclusive of road easements or rights-of-way. 6. The northern parcel establish a minimum lot width of two hundred (200') feet. 7. The Parcel Plat shall show any surface drainage or FEMA flood zones. " PAGE 2 Of BK 20n PG 4 5 (FEEt92-3n65) ..- . . The Board of Supervisors accept the dedication of a forty-two foot (42') road right-of-way along the northern boundary of this parcel and a thirty-five (35') foot road right-of-way along eastern boundary and a twenty (20') foot radius curve at the northeast corner of the subject property. In addition the granting of an eight (8') foot public utility easement along the east and northern boundaries of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/ granting statement and dedication/granting be shown on the Parcel Plat. 9. No building/zoning permits shall be issued until after Parcel Plat recordation. 10. That appropriate zoning/building/environmental permits be obtained. 11 The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being August 5, 1992, as per ARS 11-829E. 12. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use/for which it was conditionally approved, the Board aftef notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Parcel Flat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on June 21, 1992, and posted June 19, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. Resolution No. 92-234 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 6, 1992 approved this Amendment to the Mohave County Zoning Regulation through the change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
