A RESOLUTION SETTING FORTH THE REZONING OF LOTS 143 AND l44, LAKE
HAVASU HIGHLANDS, TRACT 1085-A .AND LOT 28, LAKE HAVASU HIGHLANDS,
TRACT 1001, SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM:
C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-2H (HIGHWAY
COMMERCIAL) ZONE, LOCATED IN THE LAKE HAVASU AREA, MOHAVE COUNTY,
ARIZONA

WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on October 5, 1992, a public hearing was
conducted to determine whether approval should be granted to
William and Lori Montgomery of Kingman, Arizona, for a zone
change from the existing C-2 (General Commercial) zone to C-2H
(Highway Commercial) zone, located on the west side of London
Bridge Road between Perlite Place and Tourmaline Street in the

Lake Havasu area, and
WHEREAS, Section 21 is located immediately north and west of
Lake Havasu city.
It is also bisected by Highway 95 and old
Highway 95 now known as London Bridge Road. The subject property
has frontage on the west side of London Bridge Road between
Perlite Place and Tourmaline Street, and
WHEREAS, review of floodplain map #040058-31l0B indicates
this site to be clear of a designated floodplain. Lots 144 and
28 are the current site of a retail nursery.

currently occupied by some large vehicles and miscellaneous
materials.
These lots are all zoned C-2 (General Commercial).
Surrounding land uses consist of commercial uses along both sides
of London Bridge Road, residences to the northwest and southwest,
with vacant land to the west, and
WHEREAS, the applicant desires to establish swimming pool
sales on Lot 28 in conjunction with the retail nursery. Lot 143
is slated for possible expansion of the nursery, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on September 9,
1992, the
Commission recommended a conditional APPROVAL of the requested
rezoning with the applicant understanding and accepting the
following conditions:

The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.

THE FOLLOWING ITEM APPLY TO ENVIRONMENTAL REQUIREMENTS.
2.
Applicant submit proof of hookup to an approved sewage
treatment facility and community water system.
NOTE:
THE FOLLOWING ITEMS APPLY TO TRANSPORTATION RELATED
REQUIREMENTS.
3. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.

THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS.
A buffer, in the form of a six (6') foot block wall
shall be required along all boundaries where commercial
and residential uses and zoning abut. In addition, a
buffer along the front of Lot 143, except approved
entrance points, is required, Any gates for the
entrance points shall be view obscuring. (Commission
would consider an alternate design approved by staff to
assure lot protection and non-access in lieu of a block
wall. )
That appropriate zoning/building/environmental permits
be obtained.
Any remainder of the lot not used for development shall
be maintained free of debris and the vegetation
controlled to minimize potential fire hazards.
Grasses /weeds shall be cut regularly to assure less
than eight (8") inches of growth. If crushed rock is
used then the soil shall be maintained in a weed free
condition.
7.
Any permitted open lot storage must be related to or be
an accessory to the primary business. The storage area
shall be covered with a dust-proof surface. If crushed
rock is used for the dust-proof surface then the soil
shall be maintained in a weed free condition. Any open
lot storage shall be completely enclosed by a view-
obscuring fence which extends two (2') feet above the
highest item to be stored, with a minimum of six (6')
feet and a maximum of eight (8') feet in height.
Fencing shall display no advertising.

8. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
November 4, 1992, as per ARS 11-829E.

If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on September 19, 1992, and in the Today Daily
News, and posted September 17, 1992 as required by Arizona
Revised Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, October 5, 1992 approved this
change in zoning as recommended by the Mohave County Planning and
zoning Commission and outlined herein.
