A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 53, COTTONWOOD
MOUNTAIN RANCHES, SECTION 20, TOWNSHIP 22 NORTH, RANGE 12 WEST,
FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM
LOT SIZE) ZONE, PROPOSED TO BE: A-R/17A (AGRICULTURAL
RESIDENTIAL/SEVENTEEN ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE
MOHAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 8, 1992, a public hearing was
conducted to determine whether approval should be granted to
Susan, Michael and Irene Buliavac and Michael Magabilin of San
Clemente, California, for a zone change from the existing A-R/36A
(Agricultural Residential/Thirty-six Acre Minimum Lot Size) zone
to A-R/17A (Agricultural Residential/Seventeen Acre Minimum Lot

Size) zone, occupying the northeast corner of Galletta Road and
Side Oaks Road in the Mohave County General area, and
WHEREAS, Section 20 is approximately four and one-half (4.5)
miles east of Hackberry Road and approximately seven (7) miles
south of the Highway 66 and approximately twenty-five (25) miles
northeast of the Kingman City Limits.

northwest corner of the subject property, and
WHEREAS,
review of
the
floodplain map
#040058-2225B
indicates this parcel to be located within a FEMA UNMAPPED AREA
with the recommendation,
"Do Not Build in Possible Flood
Boundaries of any Wash".
The property is currently vacant.
Surrounding properties are vacant.
The applicant desires to
split this 36+ acre parcel into two 17+ acre parcels, and
WHEREAS, at the public hearing before the Mohave County

Planning and Zoning Commission on August 12, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:

1. The two parcels be zoned A-R/17A (Agricultural-
Residential/Seventeen Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The two parcels shall meet or exceed seventeen (17)
acres exclusive of road easements or rights-of-way.
6. The Parcel Plat shall show any surface drainage or FEMA
flood zones.

7 . The Board of Supervisors accept the granting of an
eight ( 8') foot PUE along the western and southern
boundaries of this parcel. This shall be approved
through the recording of the resolution authorizing
this zone change, and that the granting statement and
granting be shown on the Parcel Plat.
8. No building/zoning permits shall be issued until after
Parcel Plat recordation.
9. That appropriate zoning/building/environmental permits
be obtained.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
October 9, 1992, as per ARS 11-829E.
11. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832. ~.-
At the request of Roqer ESGuerra, cartoqrapher, the Planninq
Commission recommends Parcel Plat boundaries be a triple
wide line as the 1/8" blue line border obscures dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on August 22, 1992, and posted August 21, 1992
as required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 8, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
