HomeMy WebLinkAbout92-298 ~ -- ~ ~()7 .--~,~! :,,; ::" lMCRDflU;H;.ij - ~.d! fNOEXEO =fi:92- 5C;693 .BK 2107 PG, 403 OFF!CIAL RECORDS OF HOHAVECOUl,TY "'Z. *JOAN HoCM_L1 NOHAVE COUNTY RECORDER* t19/14-i92 3:30 P.n. ~AGE liiF 3 r;OHAVE COUNTY BOARD Of SUPERVISORS REcnRDI~~ FEE 0.00 He RESOLUTION NO. 92-298 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE REZONING OF LOT 13, BLOCK I, GOLDEN SAGE RANCHOS t56, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE,: C-2H (HIGHWAY COMMERCIAL) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1992, a public nearing was conducted to determine whether approval should be granted to Frank Patrao of WestT(linister, California, for an extension of time for the rezoning of Lot 13, Block I, Golden Sage Ranchos t56, from the existing A-R (Agricultural Residential) zone, to C- 2H (Highway Commercial) zone, conditionally approved per Resolution No. 90-48, located south of Highway 68 and two hundred fifteen (215') feet east of Tooman Road in the Golden Valley ~..- area, and WHEREAS, Golden Sage Ranchos is located approximately one- quarter (.25) mile from th9 Highway 68 and 93 junction and is bisected by Highway 68. The subject property fronts on the south side of Highway 68 apprOximately two hundred fifteen (215') feet east of Tooman Road. Review of the Golden Valley Area Plan indicates this site is within the commercially designated area _.=~""'=,,~. ....-, .~."-" =~-'.~~~--- -'- . . At this time there are no utilities or improvements in this section south of Highway 68, and WHEREAS, the applicant applied for C-2H zoning which was conditionally approved in February, 1990. The applicant has indicated to the Commission his reasoning for requesting the first extension of time was the difficulty in getting necessary utilities extended to his property in addition to economic factors which would allow him to incur the necessary expenses for needed infrastructure. The applicant requested a two (2) year extension. A one (1) year extension was granted via Resolution No. 91-106. The applicant is requesting an additional extension ",-..;_.1 for a two (2) year time period again stating economic factors are the justification for the request. The applicant indicates that the cost for putting in infrastructure and building a commercial ~-- facility is preventing the completion of the original conditions of rezoning, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. The applicant supply proof of due diligence in his continuing efforts to meet the conditions set forth in Resolution 90-48. ... .-\ . . This extension of time be granted for this use until February 2L 1993. 4. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman l-:-: Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 22, 1992, and posted August 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. ~.- NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1992 approved the granting of this extension of time for a conditional Zone Change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
