A RESOLUTION SETTING FORTH THE REZONING OF THE E~ S~ PARCEL 152,
SECTION 23, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/I0A
(AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE,
PROPOSED TO BE: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM
LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 8, 1992, a public hearing was
conducted to determine whether approval should be granted to
Ralph Elwood of Phoenix, Arizona, for a zone change from the
existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot
Size) zone to A-R/2A (Agricultural Residential/Two Acre Minimum
Lot Size) zone, occupying the northwest corner of Heber Road and

Newgard Drive in the Golden Valley area, and
WHEREAS, Section 23 is approximately one and one-half (1.5)
miles south of Highway 68 and approximately two (2) miles west of
the Highway 68 and 93 junction. The subject property is accessed
from Highway 68 via Aztec Road south approximately two (2) miles
to Newgard Drive, thence west approximately seven hundred (700')
feet to the southwest corner of the subject property, and

indicates this parcel to be clear of a designated floodplain.

The property is currently vacant.
Surrounding land uses consist
of primarily vacant land with an existing batch plant northeast
of the property.
The applicant desires to split this 10+ acre
parcel into two 2+ acre parcels and one S+ acre parcel.
This
property is located approximately one-half (.S) mile south of the
Valley Pioneer Water Co. district and is within the Building Code
area, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on August 12, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:
1.
The two eastern parcels be zoned A-R/2A (Agricultural-
Residential/Two Acre Minimum Lot Size) and the western
parcel be zoned A-R/SA (Agricultural-Residential/Five
Acre Minimum Lot Size).

2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
S. The two eastern parcels shall meet or exceed two (2)
acres and the western parcel five (S) acres exclusive
of road easements or rights-of-way.
6.
The Parcel Plat shall show any surface drainage or FEMA
flood zones.

7 . The Board of Supervisors accept the dedication of a
thirty (30') foot right-of-way along the eastern and
southern boundaries of this parcel and twenty (20')
foot radius curve at the southeastern corner of this
parcel. Also the granting of an eight (8') foot PUE
along the eastern and southern boundaries of this
parcel. This shall be approved through the recording
of the resolution authorizing this zone change, and
that the dedication statement and dedication be shown
on the Parcel Plat.
8. No building/zoning permits shall be issued until after
Parcel Plat recordation.
9. That appropriate zoning/building/environmental permits
be obtained.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
October 9, 1992, as per ARS 11-829E.
11. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Parcel Plat boundaries be a triple
wide line as the 1/8" blue line border obscures dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on August 22, 1992, and posted August 21, 1992
as required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 8, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
