RESOLUTION NO. 92-296
A RESOLUTION AMENDING RESOLUTION 92-109, MODIFYING THE
CONDITIONALLY APPROVED ZONING USE PERMIT FOR THE ESTABLISHMENT OF
AN ABOVE GROUND PROPANE TANK FOR RETAIL SALES IN A C-2 (GENERAL
COMMERCIAL) ZONE, LOCATED ON LOT 101, GATEWAY ACRES #10. SECTION
19, TOWNSHIP 25 NORTH, RANGE 19 WEST, LOCATED IN THE DOLAN
SPRINGS AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 8, 1992, a public hearing was
conducted to amend Resolution No. 92-109 which approved a Zoning
Use Permit (ZUP) for establishment of an above ground propane
tank for retail sales in a C-2H (Highway Commercial) zone,
changing to c-2 (General Commercial) zone, located on Lot 101,
Gateway Acres #10, Section 19, Township 25 North, Range 19 West,

occupying the northeast corner of Pierce Ferry Road and Highway
93 in the Dolan Springs area, and
WHEREAS, the Pierce Ferry Road and Highway 93 junction is
approximately thirty (30) miles northwest of Kingman. The
subject property occupies the northeast corner of this junction
and is accessed via Pierce Ferry Road but has frontage on Highway
93 right-of-way, and
WHEREAS, review of floodplain map #040058-1775B indicates
this area to be outside of a designated floodplain. The property

is currently occupied with a residence and commercial building.
Surrounding land uses consist of occupied commercial property to
the south and vacant land to the north and east.
The applicant
has arrangements with Arizona Department of Transportation (ADOT)
to store construction vehicles and fuel on the property while
expansion of Highway 93 is in progress, and
WHEREAS, the applicant desires to establish a one thousand
( 1,000) gallon propane tank as part of their retail operation.
Because the applicant is selling the propane as part of a
commercial use a Zoning Use Permit (ZUP) is required.
Mohave
County Zoning Regulations do not allow the storage of flammable
fuels in a commercial zone without obtaining a ZUP. This process
ensures proper safety, health and welfare standards are met, and

WHEREAS, an error was made in Resolution No. 92-109
identifyinq the property as beinq zoned C-2H (Hiqhway Commercial)
when it is actually zoned C-2 (General Commercial). This action
is requested to make that lanquaqe chanqe in the resolution. No
other lanquaqe chanqes are proposed, and
WHEREAS, the Planning and Zoning Commission at their meeting
on August 12, 1992 did recommend APPROVAL of this request to
amend Resolution No. 92-109 which changes the language of C-2H
(Highway Commercial) zoning to C-2 (General Commercial) zoning,

WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona on August 22, 1992, and posted August 20, 1992 as
required by Arizona Revised Statutes and Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September, 1992, approved
this modification to Resolution No. 92-109 as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
