'~,~;) F\ Llf.tu RESOLUTION NO. 92-292 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF AN ELECTRICAL SUBSTATION FACILITY IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE, IN A PORTION OF THE SW~ SECTION 6, TOWNSHIP 18 NORTH, RANGE 21 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 8, 1992 a public hearing was conducted to determine whether approval should be granted to Thomas Ferry, Division Manager, CITIZENS UTILITIES COMPANY in Kingman, Arizona, for a Zoning Use Permit (ZUP) for the establishment of an electrical substation facility in an A-R (Agricultural Residential) zone located in a portion of the SW~ Section 6, Township 18 North, Range 21 West, located west of ..,.:.. .... Girard Avenue, six hundred (600') feet south of Boundary Cone Road in the South Mohave Valley area, and WHEREAS, Section 6 is located approximately five (5) miles south of Bullhead City's southernmost border and approximately two (2) miles east of Highway 95. The subject property is accessed from Highway 95 via Boundary Cone Road east approximately two and one-half (2.5) miles to Girard Avenue thence south approximately six hundred (600') feet on the west side of the road, and " " . . The site is currently vacant. Surrounding land uses consist of vacant land with two (2) proposed subdivisions: Mountainside Ranch, Tract 4106 to the north and The Highlands, Tract 4091 to the southwest. The applicant is Citizens Utilities Company. They intend to establish an electrical substation to provide service to development in Section 6, T18N, R21W and Section 12, TI8N, R22W, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on August 12, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provls10ns of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. .:a.:;.. ;10"- 2. That appropriate zoning/building/environmental permits be obtained. 3. That Citizens Utilities Company address the concerns expressed by BLM in their letter to Staff dated July 13, 1992 regarding potential impacts on Desert Tortoise. 4. In view of the potential residential development in this area that a buffer in the form of a six (6') block wall be placed on the perimeter of this site except approved entrance points. 5. That when Girard Road is built and paved by neighboring development that paved access to this site be provided. .... '. ,~ . Resolution No. 92-292 . If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 7. This zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 8. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 22, 1992, and in the Mohave Valley Daily News, and posted August 20, 1992 as required by the Arizona ... - Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions ," MOHAVE COUNTY BOARD OF SUPERVISORS ~,~ ~ ~//cU-/ J.
