A RESOLUTION SETTING FORTH THE REZONING OF LOT 30, BLOCK 0,
TIERRA VERDE, TRACT 1073-A, SECTION 14, TOWNSHIP 19 NORTH, RANGE
22 WEST, FROM: C-1 (NEIGHBORHOOD COMMERCIAL) ZONE, PROPOSED TO
BE: c-2H (HIGHWAY COMMERCIAL) ZONE, LOCATED IN THE SOUTH MOHAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 8, 1992, a public hearing was
conducted to determine whether approval should be granted to John
Voldo of Bullhead City, Arizona, for a zone change from the
existing C-l (Neighborhood Commercial) zone to C-2H (Highway
Commercial) zone, located on the east side of Highway 95
approximately three hundred ten (310') feet north of Camp Mohave
road in the South Mohave Valley area, and

WHEREAS, Section 14 is located immediately south of Bullhead
City and the NW~ is bisected by Highway 95. The subject property
has frontage on the east side of Highway 95 approximately four
hundred forty (440') feet north of Camp Mohave road, and
WHEREAS, review of floodplain map #040058-2435D indicates
this area to be in a designated floodplain. The 17,600+ square
foot site is currently vacant. Surrounding land uses consist of
a shopping center to the south, a commercial buildin9 to the

north and residences to the east across a twenty-five (25') foot
alley, and
WHEREAS, the applicant intends to establish an automotive
transmission shop.
The Planning Commission received a request
from one of the notified property owners that he requests a
visual buffer be erected to protect the residences. This rezone
request is in conformance to the South Mohave valley Area Plan,
and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on August 12, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:

1.
The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Section 27. P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
NOTE:
THE FOLLOWING ITEM APPLY TO ENVIRONMENTAL REQUIREMENTS.
2.
Applicant submit proof of hookup to an approved sewage
treatment facility and community water system.
NOTE:
THE FOLLOWING ITEMS APPLY TO TRANSPORTATION RELATED
REQUIREMENTS.
3. The applicant obtain required ADOT permits for access
to Highway 95.
4. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.

NOTE:
5.
The applicant shall pave all driveway access and
parking in accordance with Mohave County Standard
Specification #171, or better.
THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS.
6 .
A buffer, in the form of a six (6') foot block wall
shall be required along the east boundary where
commercial & residential uses and zoning abut.
(Commission would consider an engineered design to
assure lot protection and non-access in lieu of a block
wall.)
7.
That appropriate zoning/building/environmental permits
be obtained.
8.
Any remainder of the lot not used for development shall
be maintained free of debris and the vegetation
controlled to mlnlmlze potential fire hazards.
Grasses /weeds shall be cut regularly to assure less
than eight (8") inches of growth. If crushed rock is
used then the soil shall be maintained in a weed free
condition.
9 .
Any permitted open lot storage must be related to or be
an accessory to the primary business. The storage area
shall be covered with a dust-proof surface. If crushed
rock is used for the dust-proof surface then the soil
shall be maintained in a weed free condition. Any open
lot storage shall be completely enclosed by a view-
obscuring fence which extends two (2') feet above the
highest item to be stored, with a minimum of six (6')
feet and a maximum of eight (8') feet in height.
Fencing shall display no advertising.

10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
October 9, 1992, as per ARS 11-829E.
11. I f these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was' conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona: Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
'.,
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on August 22, 1992, and in the Mohave Valley
Daily News, and posted August 20, 1992 as required by Arizona
Revised Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 8, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
