A RESOLUTION AMENDING RESOLUTION 92-102, MODIFYING THE
CONDITIONALLY APPROVED ZONE CHANGE OF A PORTION OF THE NW~ SW~
SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND
SUBDIVIDED AS AZTEC VILLAGE, TRACT 4144, FROM: A-R (AGRICULTURAL
RESIDENTIAL) ZONE, PROPOSED TO BE: R-M/8M (MULTIPLE FAMILY
RESIDEN'fIAL/EIGHT THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE,
LOCATED IN THE SOUTH MORAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 8, 1992, a public hearing was
conducted to amend Resolution No.
92-102,
modi fy ing the
conditionally approved zone change of a portion of the NW~ SW~
Section 23, Township 19 North, Range 22 West, to be known and
subdivided as AZTEC VILLAGE, Tract 4144, from the existing A-R
(Agricultural Residential) zone to R-M/8M (Multiple Family
~--
Residential/Eight Thousand Square Foot Minimum Lot Size) zone,
located one-quarter (.25) mile east of Highway 95 on the north
side of Aztec Road in the South Mohave Valley area, and
WHEREAS, Section 23 is located one (1) mile south of
Bullhead City's southernmost border and is bounded by Highway 95,
Camp Mohave Road, Mountain View Road and EI Rodeo Road. The
subject property is accessed from Highway 95 via Aztec Road east
approximately one-quarter (.25) mile on the north side of the
road, and

WHEREAS, the site is currently vacant.
Surrounding land
uses consist of Courtney Greens, Tract 4054-B to the east, Mohave
Valley Business Park, Tract 4029-A to the west and Riverside
Adventure Trails R-V park to the north.
The preliminary
subdivision plan depicts 4.08 acres divided into fourteen (14)
lots having a minimum lot size of 8,020 square feet and maximum
of 12,380 square feet for an overall density of 3.43 lots per
acre. No information has been submitted regarding the potential
density of dwelling units per lot.
WHEREAS, this rezone request from A-R to R-M/8M was approved
with the following conditions via Resolution No. 92-102:

Preliminary Plat approval in Resolution 92-65.

The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.

3. The establishment of a minimum lot size based on the
size of lots per the recorded Final Plat.
4. All lots shall meet or exceed eight thousand (8,000)
square feet exclusive of roadways.
5. The minimum setbacks for this development shall be the
standard R-M setbacks as described in the regulations.
6. Arizona Department of Environmental Quality approves
the water supply and distribution system.
7. Applicant supplies proof of hookup to an approved
community water supply for this development.
8. Applicant supplies proof of hookup to an approved
offsite sewage treatment facility for this development.

9. A buffer, in the form of a six (6') foot block wall
shall be required along the entire boundary where
multifamily & residential uses and zoning abut except
approved entrance points. (Commission would consider
an engineered design to assure lot protection and non-
access in lieu of a block wall.)
10. Adequate parking shall be implemented in accordance
with the Mohave County Zoning Ordinance.
11. The applicant shall pave the driveway access and
parking in accordance with Mohave County Standard
Specification #171, or better.
12. Pertinent Zoning, Building & Environmental permits be
obtained.
13. The rezone shall become effective upon the recordation
of the Final Plat. If development is phased, then only
the zoninq for that phase shall become effective.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat boundaries be a triple wide
line as the 1/8" blue line border obscures dimensions on
prints.
WHEREAS, the applicant has requested changes to conditions :0.>.-
#4 & 8. Mr. Regan via Mr. Dewald, Project Engineer, respectfully
requests that permission be granted to allow Lots 1 thru 7 to be
served with septic tanks and leach lines on a temporary basis
until sewers become available to the subdivision by whichever
sewage treatment entity will be the ultimate provider, and
WHEREAS, the Planning and Zoning Commission at their meeting
on August 12, 1992 did recommend APPROVAL of this request to
amend Resolution No. 92-102 contingent upon the following:
1. Compliance with all conditions of Resolution No. 92-102
except as noted below.

2. Condi tion 4 of said resolution be amended to read as
follows:
4. All lots shall meet or exceed six thousand (6,000)
square feet exclusive of road easements or road
rights-of-way.
3. Condition 8 of said resolution be amended to read as
follows:
8. Applicant supplies proof of hookup to an approved
offoitc sewage treatment facility for this
development. When offsite treatment becomes
available the septic tanks and leach fields will
be abandoned and the house connections will be
made to the offsite server. This procedure must
be approved by ADEQ or the County Environmental
Health Division.
4. Building permits will only be issued for Lots 1-7. No
additional building occur on the balance of the
subdivision, Lots 8-14, until offsite sewer service
becomes available.

WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave _.~
County, Arizona on August 22, 1992, and in the Mohave Valley
Daily News, and posted August 20, 1992 as required by Arizona
Revised Statutes and Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September, 1992, approved
and Zoning Commission and outlined herein.
