PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDI~G FEE 0.00 He ~l;~ ; RESOLUTION NO. 92-289 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE REZONING OF LOTS 31-34, BERMUDA VILLAGE, BEING A POR'l'ION OF SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, FROM: c-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: c-MO (COMMERCIAL MANUFACTURING/OPEN LOT STORAGE) ZONE, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1992, a public hearing was conducted to determine whether approval should be granted to David Hargus of Mohave Valley, Arizona, for an extension of time of the rezoning of Lots 31-34, Bermuda village, being a portion of Section 15, Township 17 North, Range 22 West, from the existing C-2 (General Commercial) zone, to C-MO (Commercial Manufacturing/Open Lot Storage) zone, located on the east side of ~.~ Bermuda Court approximately two hundred ten (210') feet south of Village Drive in the South Mohave Valley area, and WHEREAS, Section 15 is located approximately thirteen (13) miles south of Bullhead City's southernmost border and is immediately west of Barrackman Road. The subject property is accessed from Barrackman Road via Levee Drive thence west approximately two hundred fifty (250') feet on the east side of the street, and , ' . . Resolution No. 92-289 Page 2 PAGE 2 OF 4 BK 2107 PG 377 (FEE~92-506g4) WHEREAS, review of floodplain map #040058-2615C indicates this area to be in a designated minor floodplain. The site is currently vacant and surrounding land uses consist of commercially zoned properties on all sides with existing C-MO zoning to the south and north of these lots. The applicant intends to establish an auto repair business on this location. This rezone request is in conformance with the South Mohave Valley Area Plan, and WHEREAS, this rezone request from C-2 to C-MO was approved with the following conditions via Resolution No. 91-206: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 2. The zoning for these combined parcels be C-MO (Commercial Manufacturing Open Lot Storage/Ten Thousand Square Foot Minimum Lot Size) zone. .v.- 3. If any of these lots are sold individually the zoning shall revert to C-2 (General Commercial) or its equivalent under subsequent approved ordinance. All nonrelevant C-MO uses shall be removed when C-2 reversion goes into place. 4. Any open lot storage must be related to or be an accessory to the primary business. 5. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 6. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. " . . The applicant supply proof of hookup to an approved community water system and sewage treatment facility. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being July 3, 1991, as per ARS ll-829E. 10. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the applicant has requested an extension of time but no reason was given for not meeting the conditions of approval of Resolution No. 91-206, and w- .. WHEREAS, at the public hearing before . the Mohave County Planning and Zoning Commission on August 12, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. Continued compliance with conditions of Resolution No. 90-206. 2. Required building permits be accompanied by a site plan in accordance with Section 27.P. 3. This extension of time be granted for this use until September 4, 1993. '. . >.- . . . "" \1...."",. , Resolution No. 92-289 Page 4 PAGE .4 OF .4 BK 2107 PG 379 (FEE~92-50bS4) WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 22, 1992, and in the Mohave Valley Daily News, and posted August 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1992 approved the granting of this extension of time for a conditional Zone Change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
