PAGE i OF 4 HOHAVE COUNTY BOARD uF SUPERVISORS RECORDIHG FEE 0.00 He A RESOLUTION SETTING FORTH THE REZONING OF THE NW!..l NW!..l sW!..l AND SW!..l NW!..l SW~ SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM: R-l (SINGLE FAMILY RESIDENTIAL) AND c-2 (GENERAL COMMERCIAL) ZONES, PROPOSED TO BE: c-RE (COMMERCIAL RECREATION) ZONE, LOCATED IN THE LAKE HAVASU AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 8, 1992, a public hearing was conducted to determine whether approval should be granted to Thomas and Joan Blankenship of Lake Havasu City, Arizona, for a zone change from the existing R-l (Single Family Residential) and C-2 (General Commercial) zones to C-RE (Commercial Recreation) zone, located south of Lake Havasu Highlands, Tract 1001 and west of London Bridge Road in the Lake Havasu area, and ~.;o- WHEREAS, Section 21 is bounded on the north by Chenoweth Drive and is bounded on the south by Lake Havasu City with the west half of the section being bisected by old Highway 95 now known as London Bridge Road. The subject property is accessed from Highway 95 via Lake Drive (the "Busy B" is located at Highway 95 and Lake Drive) thence west approximately .9 miles to a "T" intersection with London Bridge Road with the property being approximately two hundred (200') feet north of this intersection, and . . Surrounding land uses consist of a mixture of commercial and residential uses. A majority of uses on London Bridge Road are commercial uses with residential uses consisting of mobile home and R-V parks, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 12, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 2. That a buffer, in the form of a six (6') foot block wall shall be required along the entire boundary. (Commission would consider an engineered design to assure lot protection and non-access in lieu of a block wall. ) ~.- 3. Applicant supplies proof of hookup to an approved community water supply for this development. 4. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 5. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 6. A one (1') foot vehicle non-access easement (VNAE) shall be established along the east boundary of this parcel contiguous to London Bridge Road's west right- of-way except approved access points. Resolution No. 92-287 7. That appropriate zoning/building/environmental health permits be obtained. 8. A site plan in accordance with Section 27.1 & 27.J for the proposed utilization of these parcels shall be submitted to Planning & zoning for review. 9. Interior roadways shall be paved in accordance with Standard Specification # 171 or better at the time of site plan review and as recommended by the County Engineer. 10. The access points be approved by the County Engineer at the time of the site plan review. 11. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being October 9, 1992, as per ARS 11-829E. 12. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and ~.- applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 22, 1992, and in the TODAY News, and posted August 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. .. .<1 . . Resolution No. 92-287 PAGE ~ OF ~ Page 4 BK 2107 ~G 372 (FEE+92-50682) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 8, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
