RESOLUTION NO. 92-286
A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE NW~
SECTION 27, TOWNSHIP 16 NORTH, RANGE 13 WEST, TO BE KNOWN AND
SUBDIVIDED AS THE ORCHARDS, TRACT 3800, FROM: A (GENERAL) ZONE,
PROPOSED TO BE: A-R (AGRICULTURAL RESIDENTIAL) ZONE, LOCATED IN
THE WIKIEUP AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 8, 1992, a public hearing was
conducted to determine whether approval should be granted to
Forrest Purdy, CHOLLA CANYON CORPORATION, of Las Vegas, Nevada,
for a zone change from the existing "A" (General) zone to A-R
(, '.-,.,;.,'
(Agricultural Residential) zone, located south of Chicken Springs
Road and west of Highway 93 in the Wikieup area, and

WHEREAS, the proposed project is located approximately
seventeen (17) miles east of Kingman on Interstate 40 and thirty-
six (36) miles south on Highway 93 in Wikieup.
The subject
property is accessed from Highway 93 via Chicken Springs Road
west approximately one hundred (100') feet on the south side of
the road, and
WHEREAS, review of floodplain map #040058-2913B indicates
this site to be clear of a designated floodplain.
This site is
currently occupied by a grove of nut trees.

uses consist of mixed commercial and residential uses to the
southeast, a church and homes to the west, State land to the
north and the rest being mostly vacant land. The existing zoning
is A (General).
The zone change requested is for A-R/IA
(Agricultural Residential/One Acre Minimum Lot Size), and
WHEREAS, the preliminary subdivision plan for THE ORCHARDS
was conditionally approved by the Board of Supervisors on July 6,
1992 via Resolution No. 92-228, and
WHEREAS,
the
preliminary
subdivision
plan
depicts
approximately fifty-eight (58) acres divided into forty-three

(43) lots having a minimum lot size of 43,560 square feet (one
acre) and a maximum of 80,000 square feet for an overall lot
density of 1.35 lots per acre, and

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on August 12, 1992, the Commission
recommended a conditional APPROVAL of the requested rezoning with
the
applicant
understanding
and
accepting
the
following
conditions:
1. Compliance with the conditions stated on the
Preliminary plat approval in Resolution No. 92-228.
2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. Compliance with Ordinance 87-1 (Dark Sky
Ordinance) is also required.

3. The establishment of a minimum lot size based on the
size of lots per the recorded Final Plat.
4. All residential lots shall meet or exceed one (1) acre
exclusive of road easements or rights-of-way.

6. The rezone shall become effective upon the recordation
of the Final Plat. Ii development is phased, then only
the zoninq for that phase shall become effective.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat boundaries be a triple wide
line as the 1/8" blue line border obscures dimensions on
prints.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on August 22, 1992, and posted August 21, 1992
as required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations. ~--
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 8, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
