RESOLUTION NO. 92-275
A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION
PLAN AND PETITION OF EXCEPTION FOR AZTEC VILLAGE, TRACT 4144,
BEING A PORTION OF THE NW~ SW~ SECTION 23, TOWNSHIP 19 NORTH,
RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE
COUNTY, ARIZONA
WHEREAS, at the special meeting of the Mohave County Board
of Supervisors held on August 17, 1992, a public hearing was
conducted to determine fan amendment of Resolution 92-651
approving of the preliminary subdivision plan and petition of
exception for AZTEC VILLAGE, Tract 4144, and
WHEREAS, the owner/developer of this project is G. Michael
Regan & Associates of Bullhead City, Arizona.
The Engineer
responsible
for plan preparation and drainage
study is
Territorial Engineers, Inc. of Bullhead City, Arizona, and
WHEREAS, the proposed subdivision is located one-quarter
( .25) mile east of Highway 95 on Aztec Road and five hundred
thirty-three (533') feet east of the west boundary of Courtney
Greens, Tract 4054-B.
Access is provided to this site from
Highway 95 via Aztec Road through Mohave Valley Business Park,
Tract 4029-A.
It is bounded on the west by Mohave Valley
Business Park, Tract 4029-A and on the east by Courtney Greens,
Tract 4054-B of this subdivision, and

WHEREAS, the preliminary subdivision plan depicts 4.08 acres
divided into fourteen (14) lots having a minimum lot size of
8,020 square feet and maximum of 12,380 square feet for an
overall density of 3.43 lots per acre, and
WHEREAS, water will be supplied by Bermuda Water Company,
Inc.; electric power by Mohave Electric CO-OP, Inc.; telephone
service by Citizens Utility Company; rsewaqe disposal for lots 1
thru 7 are to be served by septic tanks and leach lines on a
temporary basis until sewer service becomes available. The
developer will provide, to staff, a copy of the service contract
between himself and the ultimate provider.
Lots 8 thru 14 will
not be developed until community sewer becomes available;l solid
waste disposal is by Tri-State Refuse Co., to Mohave Valley
Landfill; and fire protection provided by Fort Mohave Mesa Fire
Department, and
WHEREAS, the Commission at their meeting on February 12,
1992 did recommend CONDITIONAL APPROVAL of the preliminary
subdivision plan and petition of exception for Tract 4144, with
the following noted:
1. Petition of exception is submi ttedfor the following
exception:
a. Eight (8') foot public utility easement adjacent to
the project streets in-lieu of rear lot PUE's per the
subdivision regulations. This is a standard exception
and will not be detrimental to the public health,
safety or welfare nor injurious to adjacent properties.

b. The Commission recommended APPROVAL of the Petition
of Exception based on the aforementioned justification.
2. The conditional approval of this subdivision is based
on the understanding of the Planning and Zoning
Commission that all streets within the subdivision will
be constructed and paved with asphaltic concrete in
accordance with Standard Specifications #171 and
#101.10D or better; the streets shall include curb and
gutter; a water supply and distribution system
including fire flow will be constructed to serve each
lot; grading and drainage related improvements will be
completed as recommended by the design engineer and as
approved by the County Engineer in the submitted and
approved drainage reports; arrangements will be made to
extend underground electric and telephone service to
each lot in accordance with Arizona Corporation
Commission regulations; approval for water system and
sewage disposal shall be obtained from the Arizona
Department of Environmental Quality prior to recording
the Final Plat; rbecause sewer service is not available
at present, lots 1 thru 7 will be conditionally allowed
service with septic tanks and leach lines on a
temporary basis until sewer service becomes available
to the subdivision, lots 8 thru 14 will remain
undeveloped until community sewer is available at which
time the FMTUA and or SORENSON aqreement for sewer
services shall be filed with the P&ZC staff; 1 water
availability statement to be obtained from the Arizona
Department of Water Resources; all lots and street
centerline monuments will be staked and monumented in
accordance with Standard Specification #102; fire
hydrants will be provided at locations prescribed by
the Fort Mohave Mesa Fire Department; street name and
regulatory signs will be installed in accordance with
the requirements of the Mohave County Subdivision
Regulations and as recommended by the design engineer
and; the owner/subdivider is responsible for the
completion of improvements and shall provide assurance
for all required subdivision improvements in accordance
with Article V of the Subdivision Regulations.
3. The developer will make the same commitments for
improvements in the prospectus to the State Real Estate
Commission as required for approval of this tract by
the Board and a final copy of the State Real Estate
Report shall be submitted to P&Z staff. This copy
shall be for library purposes.
4. A final draft of the CC&R's shall be submitted with the
Final Plat submittal.

5. The County Engineer has made comments in regard to the
drainage report and the preliminary plan as submitted,
in a letter dated January 9, 1992. Staff is confident
that all concerns will be addressed and resolved to the
County Engineer's satisfaction prior to submission of
this subdivision for Final Plat actions.
6. On the west boundary of the tract a five (5') foot
screen wall is illustrated on the property line. This
shall be changed to a six (6') foot block wall as a
buffer between the multifamily zoning of this project
and the single family zoning of Courtney Greens
project.
7 . The northwest corner of Lot 3, shall indicate a one
(1') foot VNAE and barrier to prevent double frontage
of this lot and ensure that the alley is not used as an
access point.
THE FOLLOWING CONDITIONS RAVE BEEN ADDED TO THIS
RESOLUTION TO ACCOMMODATE THE CHANGES INVOLVED WITH THE
SUBDIVISION:
8 .
That as stated in a meeting with staff on June 23, 1992
developers representative stated the following
conditions would be met with respect to the temporary
use of septic tanks and leach fields. That the
developer will dry sewer the project in anticipation of
utilities bringing in trunk lines to the site in the
near future. Second that only half of the project
would be allowed the use of septic tank and leach
fields. Finally that the original resolution approving
the preliminary be amended to allow for the use of
septics.
9. The cost estimate, in addition to the assurance, shall
be revised to reflect the aforementioned changes and
conditions. Furthermore, the cost estimate and the
corresponding assurance shall reflect any additional
regulatory cost which may occur with this revision.
10. An approved method of assurance and/or surety shall be
provided in the amount of the cost estimate as approved
by the Mohave County Public Works Department for the
final recorded plat, in its entirety, and all required
site improvements. A draft copy of this assurance
shall be submitted with the submittal of the final
plat.

At the request of Roqer Esquerra, cartoqrapher, Commission
recommends Final plat and Parcel Plat boundaries be a triple wide
line as the 1/8" blue line border obscures dimensions.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at
their
special
meeting
on
Monday,
August
17,
1992,
conditionally approved this ramendedl preliminary subdivision
plan and petition of exception as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
