PAGE 1 OF 4 .:.y:L~_L-.-.-/r\:j. nOHAVE COUNTY BOARD Of sUPERVISORS '~.;~.~~~'1 RECORDING FEE 0.00 He ,.,,/ ':I" ~....;7 .:.';...."',,;~' , ; - \ill:;{flFiiJ'~ED RESOLUTION NO. 92-352 A RESOLUTION SETTING FORTH THE REZONING OF S~ PARCEL 527, SECTION 6, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/5A & 8A (AGRICULTURAL RESIDENTIAL/FIVE & EIGHT ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of supervisors held on November 2, 1992, a public hearing was conducted to determine whether approval should be granted to Stephen H. and Angela R. Wilks of Kingman, Arizona, for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/5A & 8A (Agricultural Residential/Five and Eight Acre Minimum Lot Size) zones, located north of Calle Castano between Indiana and Maryland Drives in the North Kingman portion of the Mohave County General area, and WHEREAS, Section 6 is approximately three (3) miles north of the Butler area and approximately two (2) miles east of Stockton Hill Road. The subject property is accessed via Cactus Wren Road East to Cherum Road, _thence north approximately one-half (.5) mile to Calle Castano, thence east approximately one (1) mile to the southwest corner of the subject property, and . . Resolution No. 92-352 Page 2 PAGE 2 OF 4 5K 2131.PG!569 (FEEt92-610'") .WHEREAS, review of the floodplain map #040058-2155B indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land. The applicant desires to split this eighteen plus (18+) acre parcel into two (2) five plus (5+) acre parcels and one (1) eight (8) acre parcel, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on October 14, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: ..;; 1. The two eastern parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size) and the western parcel be zoned A-R/8A (Agricultural-Residential/Eight Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a m~n~mum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two eastern parcels shall meet or exceed five (5) acres and the western parcel eight acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. The Board of Supervisors accept the abandonment of the existing sixty foot (60') ingress/egress easement on the western boundary and a thirty foot ingress/egress easement on the eastern boundary of this property to be replaced by the dedication of a thirty foot (30') road right-of-way along the eastern and western boundaries of the subject property, and a twenty (20') foot radius will be needed at the southeast and southwest corners of the proposed parcels where they are contiguous to Maryland Drive and Indiana Drive. In addition the granting of an eight foot public utility easement along the southern boundary of the subject property. This shall be approved through the recording of the resolution authorizing this zone change, and that the granting statement and dedication be shown on the Parcel Plat. 10. The abandonment shall only pertain to the ingress/egress easements, the existing utility easements shall remain and be indicated and referenced to record on the parcel plat. "J 11. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being December 2, 1992, as per ARS 11-829E. ::;.:..;:1 12 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman , Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on October 17, 1992, and posted October 15, ~ . . NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1992 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
